HomeMy WebLinkAboutRes 03-74 02/19/1974 RESOLUTION NO. 3-74 A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE MOUNT PROSPECT RURAL FIRE PROTECTION DISTRICT WHEREAS. the Administration of the Village of Mount Prospect has reviewed the contract with the Mount Prospect Rural Fire Protection District for the calendar year 1974; and WHEREAS. the said Administration has recommended to the Mayor and Board of Trustees of the Village of Mount Prospect the adoption of the said agreement; and WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have ascertained that entry into this agreement is for the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the President of the Board of Trustees of the Village of Mount Prospect is hereby authorized to sign and the Village Clerk of the Village of Mount Prospect is hereby authorized to attest the agreement for rural fire protection made a part hereof and attached hereto as Exhibit I. SECTION TWO: That the said agreement shall be effective January 1, 1974, and shall be binding upon the parties thereto and their successors through December 31, 1974. SECTION THREE: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. AYES: NAYS: PASSED and APPROVED this 19th day of February, 1974. ~p ]VIayor ATTEST: ~w~ - Village Clerk ARTICLES OF AGREEMENT ARTICLES OF AGREEMENT made and entered into this Eleventh day of OCTOBER, 1973 by and between the MOUNT PROSPECT RURAL FIRE PROTECTION DISTRICT, a municipal corporation, Wheeling Town- ship, Cook County, Illinois, hereinafter referred to as the "First Party", and the VILLAGE OF MOUNT PROSPECT, ILLINOIS, a municipal corporation, Wheeling and Elk Grove Townships, Cook County, Illi- nois, hereinafter referred to as the "Second Party". wnEREAS The First Party and the The Second Party are municipal corporations organized under the. respective statutes in such case made and provided; and WHEREAS the First Party is desirous of obtaining a contract from the Second Party for the purposes of providing fire protectiont fire fighting, fire prevention and emergency services for that certain territory outlined in red ink on Exhibit A attached hereto and by reference made a part hereof. which area constitutes the entire area within the corporate limits of the First Party, and which area con- stitutes the entire and only area to be serviced by the Second Party for the First Party; and WHEREAS the Second Party is willing to enter into a contract with the First Party to supply such services to said area; KO';J. BE IT AND IT IS Hl~REBY AGREED AND UNDERSTOOD BY AND BETt1EEN THE FIRST PARTY AND THE SECOND PARTY HEREIN AS FOLLO\vS: bRTICLE I: THAT for the period beginning ONE JANUARY 1974 at 00:01 A.M. on said day, and expiring THIRTY-ONE DECEMBER 1974 at 12:00 midnight of said day, the Second Party shall furnish all fire protection, fire fighting, fire prevention and emergency ser- L vices by such volunteer, paid-on-call or full time paid firemen available to the Second Party as the "Fire Chief of the Second Party shall determine, to the First Party for said area outlined in red on said Exhibit A attached hereto. ARTICLE II: THAT for the period of time during which these Articles shall be in full force and effect First Party agrees to pay to and the Second Party agrees to accept as full payment for said fire protection, fire fighting, fire prevention and emergency services that sum of money determined by the Net Collections of the First Party's -1973- Tax Levy collected and remitted to the First Party during the calendar year of -1974- remaining after first de- ducing therefrom the expenses paid out by the First Party during the calendar year of -1974- and the payment of such sum shall be made in the manner following, to-wit: A. The sum of ONE THOUSAND DOLLARS ($1,000.00) upon the execution and delivery of these Articles; and B. The additional sum of THREE THOUSAND DOLLARS ($3,000.00) upon or before ONE JULY 1974; and C.. The additional sum of THREE THOUSAND DOLLARS ($3,000.00) upon or before ONE NOVEMBER 1974; and D. The additional balance, if any, due to the Second Party, or the credit, if any, due to the First Party, upo~ or before FIFTEEN FEBRUARY 1975. ARTICLE III: THAT the Fire Chief for the Second Party shall have the sole, exclusive right and responsibility to prescribe the manner and method of giving the alarm for fire or other emergency in the Territory to be serviced by the Second Party for the First Party. ARTICLE IV: THAT the Fire Chief designated by said Second Party shall immediately upon arriving at the scene of any alarm or emergency (or such other officers as may be designated by said Second Party) have the sole and exclusive authority and responsi- - 2 - bility to direct and control any and all fire-fighting, fire pre- vention, fire protection and emergency operations carried on at such scene or scenes, and further, that any officers and/or fire- men appointed by the First Party shall be subject to the order and direction of the Fire Chief designated by the Second Party. ARTICLE V: THAT all fire-fighting, fire protection, fire pre- vention and emergency procedures conducted under the provisions of these Articles shall be under and in accordance with the regulations and ordinances, if any, of the Second Party. And furthermore, the First Party agrees that within ten (10) days of the execution hereof, it shall pass and approve ordinances identical in form and content to the ordinances of the Second Party which deal with fire fighting, fire protection, fire prevention, building construction as related to fire safety, and other emergency procedures. ARTICLE VI: THAT all expenses of maintaining equipment, ap- paratus, salaries, insurance premiums, and any and all other items of expenses connected with the several services to be supplied by the Second Party to the First Party shall be supplied at the sole expense of the Second Party and that the only expense falling upon the First Party shall be the payments scheduled to be made herein- above in Article II. ARTICLE VII: THAT the First Party shall within seven (7) days of receipt of notice of proposed annexation by a municipality of properties within its District forward a copy of said notice with the legal description contained therein, to the Second Party by addressing said copy of notice to the' attention of the Village Clerk, 112 East Northwest Highway, Mount Prospect, Illinois. Fail- ure to forward any such notice of proposed annexation by the First Party shall not be sufficient reason for Second Party to rescind these Articles of Agreement. - 3 - :iN \ilIT1'\ESS \mEREOF the Parties hereto have caused these Articles ~o be executed by their respective officers and affixed hereunto their respective corporate seals. THAT the executive officers of the Board of Trustees of the within MOUNT PROSPECT RURAL FIRE PROTECTION DISTRICT be, and they are hereby authorized and directed to execute and deliver a cer~ain contract for fire protection services to be supplied for the calendar year of 1974 to the said Fire Protection District by the Village of Mount Prospect, Illinois, a copy of which contract in the form of certain "Aarticles of Agreement" is to this Resolution attached, bears the legend "Exhibit An thereon, and is by reference made a part of this Resolution. 2. THAT this Resolution shall be in full force and effect from and after its passage and approval according to law. PASSED AND APPROVED THIS 11th DAY OF OCTOBER, A.D. 1973.
