AF/ 7/9/96 ORDINANCE NO. 4806 AN ORDINANCE GRANTING A CONDITIONAL USE FOR PROPERTY COMMONLY KNOWN AS 10 SOUTH ELM STREET WHEREAS, Michael and Joan Schwarzbeck (hereinafter referred to as Petitioner) have filed a petition for a Conditional Use with respect to property located at 10 South Elm Street (hereinafter referred to as the Subject Property); and WHEREAS, the Subject Property is legally described as follows: Lot 18 in Subdivision of Lot "A" Block 6 in Busse and Wille's Resubdivision in Mount Prospect in the West 1/2 of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, In Cook County, Illinois; and WHEREAS, Petitioners seek a Conditional Use to permit a three (3) car detached garage; and WHEREAS, a public hearing was held on the request for Conditional Use being the subject of ZBA Case No. 12-CU-96 before the Zoning Board of Appeals of the Village of Mount Prospect on the 13th day of June, 1996, pursuant to proper legal notice having been published in the Mount Prospect Journal on the 29th day of May, 1996; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees in support of the request being the subject of ZBA 12-CU~96; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional Use would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use to the Subject Property to permit a three (3) car detached garage on the Subject Property as shown on Exhibit "A" attached hereto and hereby made a part hereof. SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
