RESOLUTION NO. 11-76
A RESOLUTION AUTHORIZING EXECUTION OF AN
AGREEMENT FOR CHANNEL IMPROVEMENTS TO
McDONALD CREEK
WHEREAS, the administration of the Village of Mount Prospect has reviewed an
agreement whereby the Village of Mount Prospect grants to the State of Illinois,
Department of Transportation, Division of Water Resources, a license in, along,
upon and over lands owned and/or controlled by the Village for channel improve-
ments to McDonald Creek; and
WHEREAS, the said administration has recommended to the Mayor and Board of
Trustees of the Village of Mount Prospect the adoption of said agreement; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect
have ascertained that entry into this agreement is for the best interests of the
Village of Mount Prospect;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the President of the Board of Trustees of the Village of Mount
Prospect is hereby authorized to sign and the Village Clerk of the Village of Mount
Prospect is hereby authorized to attest the agreement for channel improvements to
McDonald Creek made a part hereof arid attached hereto as Exhibit I.
SECTION TWO: That the said agreement shall be binding upon the signatories
thereto and upon their successor municipal authorities for the period of time set
forth therein.
SECTION, THREE: That this Resolution shall be in full force and effect from and
after its passage and approval in the manner provided by law.

AGREEMENT
THE GRANTOR, Village of Mount Prospect, a Municipal Corporation of the
tion of One and no/100 ($1. 00) Dollar in hand paid, conveys and warrants to the
State of Illinois, Department of Transportation, Division of Water Resources of the
City of Springfield, County of Sangamon, and State of Illinois, a license in, along,
upon and over lands owned and/or controlled by the Village for channel improve-
ments to McDonald Creek, in accordance with right-of-way requirements shown
in red on the attached drawings marked Exhibit "Aft, and made a part hereof.
Also, this conveyance shall include a license over streets, alleys, and other pro-
perty owned and/or controlled by the Village.
The right, license, and privilege herein granted shall terminate upon
completion and acceptance by the State of Illinois of the channel improvement pro-
ject rmt.in no event shall said right, license and privilege extend beyond Septern-
ber 1, 1977.
IN WITNESS WHEREOF, said Grantor has caused its corporate seal to be af-
fixed hereto and has caused its name to be signed to these presents by its Village
