HomeMy WebLinkAboutRes 03-76 01/06/1976 /"""'\ ...~ RESOLUTION NO. ~-76 A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE FOREST RIVER FIRE PROTECTION DISTRICT WHEREAS. the Administration of the Village of Mount Prospect has reviewed the contract with the Forest River Fire Protection District for the calendar year 1976; d WHEREAS. the said Administration has recommended to the Mayor and Board of Trustees of the Village of Mount Prospect the adoption of the said agreement; and WHEREAS. the Mayor and Board of Trustees of the Village of Mount Prospect have ascertained that entry into this agreement is for the best interests of the Village of Mount Prospect; NOW. THEREFORE. BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY. ILLINOIS:... SECTION ONE: That the President of the Board of Trustees of the Village of Mount Prospect is hereby authorized to sign and the Village Clerk of the Village of Mount Prospect is hereby authorized to attest the agreement for rural fire protection mad a part hereof and attached hereto as Exhibit I . . SECTION TWO: That the said agreement shall be effective January 1. 1976. and shall be binding upon the parties thereto and their successors through December 3 . 1976. SECTION THREE: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. AYES: 6 NAYS: 0 PASSED-this. 6th day of January. 1976. AGREEt-iLNT WHEREAS, the Village of liount Prospect, hereinafter reierrcQ to as "the Village,~ a municipal corporation organized under the laws of the State of Illinois and the Forest River Fire Protection District, hereinafter referred to as Uthe :..iist.rict, " a municipal corporation organized under the la\^lS of tlw State of Illinois, are I!'unicipal corporations organizec. unu~r ~he laws of the State of Illinois and as such have the power under state law to enter into-agreements' for providing fire protection; and WHEREAS, tbe Village is desirous of providing such services to the District, NOW, TliliREf'ORE, IT IS AGREED BY Al.~D BET\'lEEN Tar:. Vli..LAGL Atm ThE DISTRICT AS FOLLO~~S: 1. !hat for the ~criod beginning January 1, 1976, to ul;;ceI1iiJcr 31, 1::770, at 1~~00 mio.night said day, tho Village shall furnish all fir:;: fighting, fire prot.ection, fire pre- vention, and other emergency services, including emergency ambulance servictt, by such volunteer or paid on call and/or biN/8lf L (\ i~ r&gular firemen available to the Village as t~e Fire Chief of ~le Village shall determine, to the District for a certain area as shown fu~d outlined in! orange on Exhibit I attached hereto and made a part hereof. 2. That for the period of time during which this agree- ment shall be in full force and effect, the District agrees to pay ana the Village agrees to accept as full payment for said fire protection, fire prevention services, and emergency ser- vices that amount of monies received from tax receipts collected during the period beginning January l, 1976, and ending December 31, 1976, less all costs of running ~~e said District including but not limited to all administrative legal salaries \ w,d other expenses incurred. a. It is understood that the District shall levy taxes at tile maximum rate authorized by statute without referendum; and shall apply for and make all efforta to receive any available state and/or federal aid to fire protection districts as is now available or may be made available during the term hereof1 all such levies, how- ever, shall be exclusive of the amount of taxes levied for payment of th~ bonded indebtedness of the District which existed prior to the discontinuance of the fire department of the District. It is understood that tlle ~istrict will continue to levy and extend taxes upon the taxable property in its territory for its proportionate ahara of such bonded indebtedness of ~le District at ~~e tino of ele said discontinuance for the purpose of amor- tizing such bonds until such time as sufficient funds to retire such bonds have be~n collectad. b. The payments by the District to the Village shall be made in the following manner: -2- -!o r /~ (i) The sum of FIVE HONORED ($500.00) DOLLARS shall be paid upon the execution of this agreement, (il) The sum of FIVE HUnDRED ($500.00) wLL.~RS on or before April 1, 1976. (ill) The sum of FIVE HOttOF.ED ($500.00) DOLLARS on or before July 1, 1976. (iv) The balance remaining after all expenses hav.e been paid shall be paid on or before Decem- ber 31, 1976. J. That the Fire Chief of the Village shall have the and exclusive right, duty, and responsibility to prescribe manner and method of giving the alarm for fire and/or othel emergencies occurring wiL~n the District's territory as 01 lined upon said Exhibit I. 4. That the Pire Chief of the Village or his author!: representative shall have the sole and exclusive authority responsibility to direct and control any and all fire figh1 fire protection, fire prevention, and other emergency oper. carried on at the scene of any alarm or emergency occurrini within that territory of the District shown upon the said Exhibit 1. 5. That all fire fiqhtinq, fire protection, fire pre' tion and other emergency procedures conducted under the prl sions hereof shall be oonducted in accordance with the regulations of the Mount Prospect Fire Department and the ordinances of the Village. Furt..'I1ermore, the District agre. that within ten (10) days of the execution hereof, it shal pass and approve ordinances identical in form and content the ordin~~cea of the Village which deal with fire fiqhtin -3- ~ o i~ fire protection, fire prevention, building construction as re- lated to fire safety, ar~d other emergency procedures. 6. That all ~xpunsc and cost of maintaining equip~ent, apparatus, salaries, insurance prer.~ums, and any and all other itenLS of expense connected with the several services contem- plated herein to be supplied by the Village to the District shall be borne by tne Village. The only expense falling upon ~le uistrict snaIl oe in the form of the payments scheduled to be made hereinabove under .Para.braph 2b. 7.
