RESOLUTION NO. 5- 75 A RESOLUTION BY THE VILLAGE OF MOONT PROSPECT OBJECTING TO THE REZONING OF CERTAIN R-4 "SINGLE FAMILY RESIDENCE DISTRICT PROPERTY TO B-4 H GENERAL SERVICE DISTRICT", WHICH PROPERTY IS LOCATED ON THE NORTH SIDE OF GOLF ROAD: DESIGNATED BY THE COOK COUNTY ZONING BOARD OF APPEALS AS DOCKET #2573. WHEREAS, the Petitioner in Z.A. #A-74-45 seeks a rezoning of certain property loca't:ed on the north side of Golf Road approximately 147 'feet west of Meyer Avenue from its R-4 (Single Family Residence District) to B-4 (General Service District), which case was docketed by the Cook County Zoning Board of Appeals as Docket #2573; and WHEREAS, the Village of Momt Prospect lies within one and one-half miles of the property sought 1;:0 be rezoned and wholly surromds same; and WHEREAS, the Village of Momt Prospect appeared at Public Hearing on said Docket #2573 on January 24, 1975, and then and there requested time within which to file its fonna1 obj ection to the said proposed rezoning; and WHEREAS, the President and Board of Trustees of the Village of Momt Prospect desire to exercise the authority to file a formal objection, which authority has been conferred upon them by Section 3158 of Chapter 34 of the Illinois Revised Statutes; NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILlAGE OF IvDUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Village of Momt Prospect does hereby obj ect to the rezoning described herein above and requests that the Comty Board vote in a.ccord with this official objection, and does hereby state the reasons for the said objection as follows: . (1) That the rezoning of the subject tract would amomt to spot zoning in that: properties lying immediately to the south, north, and east of the subj ect parcel are presently zoned single family residential and are improved as such -- in fact the existing use and zoning of most nearby properties is predominantly residential. (2) That the property is sui!:ab1e for the purposes for which it is zoned and presently occupied and utilized as zoned. (4) That the primary use of the property as described by the petitioner is for the operation of a tavern within the existing building, which has been shown to be of a construction inadequate to meet the standards necessary for a connnercial building lying wi thin any fire hazard conflagration district. That the value of the property is not unreasonably diminished by the restrictions of the existing zoning -- so .that the gain to the public from the existing zoning of the subj ect property under present zoning ordinance is great as compared to any possible economic hardship on the property owner. (5) The character of Golf Road does not render the subject property (3) ,~ t~ ,~, , , /~ ~ " .. .., tmSuitable for single family purposes; the highest and best use of the subject property is for single family use. SECTION TWO: 'That the Village Clerk is hereby authorized to submit certified copies of this Resolution to the Clerk of Cook Comty as well as to the Secretary of the Zoning Board of Appeals of Cook County for transmittal to the County Board and such other agencies as are deemed appropriate. SECTION TIlREE: That this Resolution shall be in full force and effect from an after its passage and approval in the manner provided by law.
