HomeMy WebLinkAboutRes 12-75 04/01/1975 ~\ ,~ -- .t;: RESOLUTION 12-75 RESOLUTION DESIGNATING THE DES PLAINES- MOUNT PROSPECT-ARLINGTON HEIGHTS- PALATINE WATER COMMISSION AS AGENT WITH RESPECT TO LAKE MICHIGAN WATER ALLOCATIONS WHEREAS, the Village of Mount Prospect is a member of the Des Plaines-Mount Prosp ct Arlington Heights~Palatine Watei' Commission; and WHEREAS, the Illinois Department of Transportation is currently holding hearings concerning the allocation of water' diverted from Lake Michigan; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find and determine that the public health, safety and welfare of the Village of Mount Prospect requires that it receive a supply of Lake Michigan water for its residential, commercial, industrial and other needs; and WHEREAS, the Des Plaines-Mount Prospect-Arlington Heights-Palatine "DAMP" Water Commission has actively participated in the aforesaid water allocation hearings and proceedings preliminary thereto; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find and determine that the best interests of the Village of Mount Prospect would be serVed by designating the' DAMP Water Commission as its agent to file and prosecute an application for an allocation of Lake Michigan water; and WHEREAS, the Illinois Department of Transportation has required that such designations be filed' on forms supplied'by it; NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEE OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The Des Plaines-Mount Prospect"..Arlington Heights~Palatine Water Commission be, and it is hereby designated as the representative and agent responsible to file and process an application on behalf of the Village of Mount Prospect for an allocation of Lake Michigan water and to do all other things necessary or proper to secure such allocation on behalf of the Village of Mount Prospect. SECTION TWO: That the President of the Village of Mount Prospect be, and he is hereby directed to execute the "Designation of Representative'" form attached hereto as Exhibit A and by this reference incorporated herein, and the Village Clerk be and he is hereby directed to attest such execution and to affix the seal of the Village of Mount Prospect to such form. SECTION THREE: This designation may be revoked by the adoption of a resolution providing for such revocation and the delivery of a certified copy thereof ~\ i .~\ to the Des Plaines-Mount Prospect-Arlington Heights~Palatine Water Commission and to the State of Illinois, Department of Transportation, Division of Water Resources. SECTION FOUR: This designation shall not be construed to authorize the expenditure of any funds of the' Village Of Mount Prospect by the DAMP Water Commission, except as such expenditures' may have heretofore been, or may here- after be, specifically' authorized. SECTION FIVE: This Resolution shall be construed to authorize and ratify the filing, by the DAMP Water Commission, of an Application for Permit dated January 24, 1975, and all acts preparatory thereto and subsequent thereto relating to the processing and presecution of said application. SECTION SIX: This Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
