VVVL 4~8~96 ORDINANCE NO. 4791 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT121 SOUTH EDWARD STREET WHEREAS, John Flickinger (hereinafter referred to as the Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 121 South Edward Street (hereinafter referred to as Subject Property), legally described as: Lot 12 in Block 12 in Busse's Eastern Addition to Mount Prospect in the east half (112) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, the Petitioner seeks a variation from Section 14.1005.B.1 to allow a rear yard setback of 12.5 feet, instead of the required 25 feet, in order to construct a room addition and a three-car garage; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 7-V-96 before the Zoning Board of Appeals of the Village of Mount Prospect on the 14th day of March, 1996, pursuant to due and proper notice thereof published in the Mount Prospect Journal on the 28th day of February, 1996; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 7-V-96 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE ET ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 15.1005.B. 1 to allow a 12.5 foot rear yard setback in order to allow construction of additional living space and a three- car garage. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variation granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance.
