CAF/ 3114196 ORDINANCE NO. 47RR AN ORDINANCE GRANTING EXCEPTIONS FROM CHAPTER 16 ENTITLED "DEVELOPMENT CODE" OF THE VILLAGE CODE OF MOUNT PROSPECT FOR THE MOUNT PROSPECT POST OFFICF WHEREAS, the Mount Prospect Post Office (hereinafter referred to as Petitioner) has requested exceptions from the Development Code (Chapter 16) of the Village of Mount Prospect for property generally known as the Mount Prospect Post Office (hereinafter referred to as Subject Property) located at 300 West Central Road and legally described as follows: Mount Prospect Post Office Plat of Consolidation of the West 70.00 feet of Lots 1 through 10, both inclusive, in block 3, together with Block 4, excepting therefrom the Northerly 200.00 feet of the Westedy 237.00 feet thereof, all in "The Ernst Busse Addition to Mount Prospect", being a subdivision of the south 543.00 feet of the East Half of the southwest Quarter of Section 34, Township 42 North, Range 11, East of the third Principal Meridian, according to the plat thereof recorded on September 10, 1915 as Document No. 5708075, all in Cook County, Illinois, also excepting from Block 4, that portion used and dedicated for roadway as shown hereon; and WHEREAS, the Petitioner is requesting exceptions from Section 16.403.A.1 of the Development Code (Chapter 16) to permit a public right-of-way of thirty feet (33') for that portion of Central Road that abuts the Subject Property, instead of the required 50', and to permit a public right-of-way of twenty-seven feet (27') for that portion of Elmhurst Avenue that abuts the Subject Property, instead of the required 33'; and WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the proposed exceptions from the Development Co~le (Chapter 16) for the Subject Property at their regular meeting on March 6, 1996; and WHEREAS, the Plan Commission has forwarded its recommendation relative to the exceptions requested herein to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have determined that the best interests of the Village would be served in granting the exceptions requested herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporate herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That the President and Board of Trustees of the Village of Mount Prospect do hereby grant exceptions from the Development Code (Chapter 16) to the Subject Property to permit a public right-of-way of thirty feet (33') for that portion of ount Prospect Post Office Modifications Page 2 of 2 Central Road that abuts the Subject Property, instead of the required 50', and to permit a public right-of-way of twenty-seven feet (27') for that portion of Elmhurst Avenue that abuts the Subject Property, instead of the required 33'. SECTION THREE: Except for the exceptions from the Development Code granted herein, all other requirements of said Development Code shall apply to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage,, approval and publication in pamphlet form in the manner provided by law.
