HomeMy WebLinkAboutOrd 2078 05/21/1968 .~, - ORDINANCE NO. 2078 AN ORDINANCE AMENDING GHAPIER 20, ARI'ICLE 2, OF THE MUNICIPAL CODE OF THE VILLAGE OF MOUNT PROSPEcr BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VIlLAGE OF MOUNT PROSPECI', COOK COUNTY, IILINOIS: SECTION 1: That Chapter 20, Article 2, Section 20.201 and Section 20,205 of the Municipal Code of the Village of Mount Prospect of 1957, as amended, be further amended by adding to Section 20.201 paragraph A and by amending Section 20.205 in its entirety so that said Section 20.201A and Section 20.205 shall be and read as follows: Section 20.201A. Violation Citations. (a) Whenever a Police Officer is authorized to arrest a person without a warrant because of a violation of this Article regulating and licensing dogs, said Police Officer may, in lieu of the filing of a complaint in Court, in the first instance issue to such alleged violator, a CITATION: 1. Advising said person that he has violated Section 20.201. 2. Requesting him to make payment in an arrount applicable to said alleged violation as set forth in this Article as settlement of said violation claim, and 3. Informing him that upon failure to so settle, a complaint will be filed in the Circuit Court of Cook County, charging him with such violation. (b) Pursuant to said CITATION, the person so accused of said violation may settle and compromise the violation claim in respect of such Section violation by paying to the municipality the applicable amount as shown in the schedule set forth in this Article, within a period to be specified in said CITATION -- not more than seven (7) days of the time said alleged offense was cormnitted. Such payment shall be made in accordance with the instructions contained in the aforesaid CITATION, at the office of the Finance Department, who shall issue a receipt for the money so received and promptly remit said arrount to the Village Treasurer to be credited to the proper municipal fund. (c) In the event that the person to whom said CITATION is issued fails to settle and pay said v::Lolation claim within the prescribed time, or within a period of time specified in a Final Notice "(if one is served upon him) then the Peace Officer is authorized to cause a Notice tio Appe"ar to be servied upon said alleged violator and is authorized to file a complaint and to prosecute the same in the Circuit Court of Cook County. (d) The violation claim described in said CITATION so to be issued pursuant to the terms of this Section, may be settled, compromised and paid in the respective arrounts set forth in the following schedule: 1. In the event that said payment is made prior to the mailing by the municipality or by the Peace Officer of a Final Notice, Five Dollars ($5.00) shall be accepted as settlement. -~ ~, _r- .. 2. In the event that payment has not been paid prior to the mailing of such Final Notice, and in fact, Final Notice has been mailed, Eight Dollars ($8.00) shall be accepted as sett lement . 3. In the event that payment is not made within the time prescribed in the Final Notice, and a Notice to appear has been served and a complaint filed in the Circuit Court of Cook County, payment of any fine and costs shall be in such arrounts as may be determined and established by the Circuit Court of Cook County. Section 20.205. Penalty. Any person, firm, or corporation violating any provision of this Article other than Sections 20.201 and 20.201A shall be fined not less than Ten Dollars ($10.00) nor more than One Hundred Dollars ($100.00) for each offense and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. SECTION 2: This Ordinance shall be in full force and effect from and after its passage, approval and pUblication in the manner provided by law.
