ORDINANCE NO. 2094 AN ORDINANCE DECLARING VILLAGE POLICY REGARDING CONFLICT OF INTEREST BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNI' PROSPECT, COOK COUNTY, ILLINOIS: I SECTION 1: That the Municipal Code of Mount Prospect of 1957, as amended, be and is further amended by adding to Article I of Chapter 8 a new Section 8.115 vlhich shall be and read as follows: "SECTION 8.115 CONFLICT OF INTEREST. (a) The proper operation of government requires that all officials, elected, appointed, and salaried employees, hereinafter referred to as Village officials be independent and impartial; that government decisions and policy be made and carried out in the proper channels of the governmental structure; that pUblic office not be used for personal gain; and that the public have confidence in the integrity of its government. The attainment of one or more of these ends is impared whenever there exists, or appears to exist, an actual or potential conflict between the private interests of a governmental official and his duties as an official. The public interest requires, therefore, that the law protect against such conflicts of interest and establish appropriate ethical standards with respect to conduct in situations where actual or potential conflicts exist. (b) No Village official shall receive, accept, take, seek, or solicit anything of economic value as a gift, gratUity, or favor but for such official's position within the government. (c) No Village official shall engage in an official act affecting his personal economic interest as outlined below: (1) No Village official shall participate in an action involving the Village in the consequences of which he has a substantial economic interest of which he may reasonably be expected to know. (2) No Village official shall participate in an action involving the Village of Mount Prospect in the consequences of which, to his actual knowledge, any of the fOllOWing persons has a direct and substantial economic interest; his spouse or child; or any person in which he has a substantial economic interest of which he may reasonably be expected to know; or any person of which is an officer, director, trustee, partner, or employee; or any person with whom he is negotiating or has any arrangement concerning prospective employment; or any person who is a party to an existing contract with such Village official or an obligee of such Village official as to a thing of economic value or who, by reason thereof, is in a position to affect directly and substantially the economic interests of such Village official. (d) Disqualification: Every Village official shall disqualify him- self from participatmg in an action involving the Village when a violation of sub-sections (b) or (c) above would otherwise result. ~ ~ - /~ (e) Members of the Village Board and all Village Cormnissioners and committees shall be required to make fUll disclosure of real property owned within the limits of the Village of Mount Prospect and within 1 1/2 miles thereof. Disclosure is to be made by such office holders in writing to the Village Clerk of Mount Prospect within 30 days of taking office. This provision is to be broadly construed to include all realty o'Lmed, or in which he has an interest, in whole or in part, and to include realty owned by spouses and other members of the official's inmediate family." SECTION 2: This Ordinance shall be in fUll force and effect from and after its passage, approval and publication in the manner prescribed by law.
