HomeMy WebLinkAboutOrd 2102 10/01/1968 /~" /'~ -~., ORDINANCE NO. 2102 AN ORDINANCE GRANTING A VARIATION FOR A FREE-STANDING BUILDING ON B-1 PRO PERrY (MOUNT PROSPECT PLAZA) FOR USE AS A "GOLDBLATI', S HCME CENTER "WI-IEREAS, THE Board of Appeals of the Village of Mount Prospect held a regular meeting on July 25, 1968 at the hour of 8:00 P.M. in the Mount Prospect Village Hall pursuant to notice pUblished in the Mount Prospect Herald on July 10, 1968; and WHEREAS, the Board of Appeals of the Village of Mount Prospect heard testimony presented tmder Case No. 68-37A pertaining to a request to construct a free-standing building on B-1 zoned property for use as a "Goldblatt's Home Center" on said property described hereunder; and v,1HEREAS, the Board of Appeals recommended to the Judiciary Corrrni ttee of the Board of Trustees of the Village of Mount Prospect to allow the variation of said free-standing building on the subject property for the use peti tioned for; and \llHEREAS, the Judiciary Corrrnittee of the Board of Trustees of the Village of Motmt Prospect subsequently met on September 12, 1968, and considered the recommendations of the Board of Appeals tmder Case No. 68-37A; an( WHEREAS., the Judiciary Committee recommended to the Board of Trustees of the Village of Mount Prospect to allow the variation as presented, with the provisions set forth by the Board of Appeals; and WHERF..AS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is for the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE rr ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: That the property being the subj ect matter of Case No. 68-37A being legally described as follows: PARCEL 1: That part of the South 1322.31 feet (measured along East line of said tract) of the E 1/2 of the S\t.l 1/4 of Section 35, Township 42 North, Range 11, East of the 3rd PM lying N.E. Ly of Center of Rand Road (except that part of the South 50 feet thereof lying N.E. Ly of the N.E. Ly line of said Rand Road taken for highvlaY purposes. PARCEL 2: The SW 1/4 of the SW l/ll of Section 35 afore- said ( excepting from said tract that part thereof lying W 4" of Rand Road), all in Cook County, Illinois. The commonly known location of this property is: Plaza Shopping Center is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-1 (Shopping Center) which zoning classification shall remain subject to the following granted variations. SECTION 2: That a free-standing building to be knoTtm as "Goldblatt's Home Center" of approximately 115,000 square feet may be constructed and erected on the legally described property above designated as Parcel 2 upon the satisfying of the following conditions: .-. r""" ~. ---. (a) That sidewalks to be installed as per Village standards on the north side of Central Road and rtm eastward from the inter- section of Rand Road to Westgate Road. (b) That the property owner make formal dedication of land for the corrpletion and irrprovement of Westgate Road northward from Central Road to the north property line of Plaza Shopping Center, namely 40 f't. wide and approximately 1272.31 feet long. (c) That two (2) easements be granted by owners of Plaza Shopping Center for water mains to rtm eastward from Plaza Shopping Center water lines to Westgate Road and that proper looping and gridding be installed. This is to provide adequate water supply for fire protection and increase water supply, if necessary, for Village property inrnediately to the east of said Plaza Shopping Center. SECTION 3: That upon the formal dedication of the land for the completion and irrprovement of Westgate Road the property owner shall be allowed an additional 15,000 square feet of building space with respect to the parking requirements as a result of the remaining net square footage of said shopping center. SECTION 4: That all requirements of the Village Code be applicable except those variations as specified in Section 2 heretofore mentioned. SECTION 5: That the Director of Building and Zoning of the Village of Mount Prospect is hereby directed to issue a building permit in accordance with the variations hereinbefore mentioned. SECTION 6: That the variation granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction commenced within one year of the date said Ordinance becomes effective. SECTION 7: This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
