HomeMy WebLinkAboutOrd 2052 02/20/1968 ,-, - 1> ORDINANCE NO. 2052 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT ESTABLISHING THE MAXIl'1UM BUILDING HEIGHT IN VARIOUS ZONING DISTRICTS. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: That an Ordinance entitled "An Ordinance Classifying, Regulating and Restricting the Location of Trades and Industries and the Location of Buildings Designed for Specified Uses; Regulating and Limiting the Height and Bulk of Buildings Hereafter Erected or Altered; Regulating and Limiting the Intensity of the Use of the Lot Areas and Regulating and Deterndning the Area of Yards, Courts and Other Open Spaces Within and SurrOlmding Such Buildings; Establishing the Boundaries of Districts for the Said Purposes; and Prescribing Penalties for the Violation of Its Provisions". passed and approved December 4, 1923, and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by amending Section 4. paragraph (e) relating to the R-2 District; R- 3 District; and R-4 District; amending Section 22 (c); amending Section 26 ''Maximum Heights" in its entirety; and amending Section 31 "Definitions", so that Section 4. paragraph (e) relating,to the R-2 District; R-3 District; and R-4 District; Section 22 (c); Section 26 " Maximum Heights ", and Section 31 "Definitions", shall be and read as follows: Section 4 - R-2 District - Bulk Regulations (e) Maxirntm1 height............................28 feet R-3 District - Bulk Regulations (e) Maximtml height............................28 feet R-4 District - Residential Planned Development _ Bulk Regulations (e) Maximum height.. . . . . . . . . . . . . . . . . . . . . . . . . . .28 feet Section 22 (C) - Height Regulations: No building shall exceed three (3) stories or 30 feet in height; p:'Ovided however. that municipal water towers, chimneys or steeples may exceed 30 feet upon variation after public hearing before the Board of Appeals and upon approval of the corporate authorities. Section 26: - Maximum Heights: No building shall hereafter be erect or structurally altered so that ceiling level of the uppermost s ry to be used as a habitation, assembly of persons, regular employme , or stroage of merchandise or supplies exceed twenty-four (24) f t in the single family residential districts (R-X, R-l, and A). or twenty-eight (28) feet in all other districts, except I-I 1-2 Districts above the average walk grade along the front of he lot opposite the building. All necessary roof structures and appurtenances nay exceed the ceiling level by not more than nine (9) feet. In all districts the naximum habitable floors is limited to three (3). Habitable rooms shall not be permitted when the floor is more than two (2) feet six (6) inches below outside finished grade. Section 31: Definitions: Geiling level height shall be that vertical distance from the finished bottom edge of the uppermost ceiling in a room used for habitation, assembly of persons, regular employment. or storage of merchandise or /),@i;o,(~J~, ~-"" - . .. supplies, as rreasured to the average walk grade along the front of the lot opposite the structure. Habitable room is a room occupied by one or more persons for living, sleeping, eating, or cooking; includes kitchens serving dwelling units, but does not include bathrooms, water closet compartments, laundries. pantrys, storage rooms, or below grade recreation rooms. MaXimUm height; The meximtml height in feet shall be the vertical distances from the average grade to the highest point of the building. Roof structures and appurtenances shall be included in the determinat- ion of maximtml height. Basements: The basement for the purpose of determining floor area of a building shall be any floor area of a building, the floor of which is tow and a half (2-1/2) feet or more below outside finished grade. SECTION 2: That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION 3: This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. AYES: 6 NAYS; 0 PASSED this 20th day of February, 1968.
