HomeMy WebLinkAboutOrd 2066 03/19/1968 ,~, ,..-, ,- ,-, ORDINANCE NO. 2066 AN ORDINANCE GRANTING A HEIGHI' VARIATION FOR PROPERTY LOCATED AT 810 EAST NORTHWEST HIGHWAY WHEREAS, the Board of Appeals of the Village of Mount Prospect did meet on January 25, 1968 at the hour of 8: 00 PM in the Mount Prospect Village Hall pursuant to notice published in the Mount Prospect Herald on January 7, 1968; and WHEREAS, the Board of Appeals of the Village of Mount Prospect heard testimony under Case No. 68-5A pertaining to a request for a variation to allow an overall building height of 34 feet 0 inches and to allow an increase in the Floor Area Ratio to 23,850 feet; and WHEREAS, the Board of Appeals recomnended to the Board of Trustees of the Village of Mount Prospect to allow the said variation petitioned for; and WHEREAS, the Judiciary Conmittee of the Board of Trustees of the Village of Mount Prospect did meet and consider Case No. 68-5A and recomrrend to the President and Board of Trustees their concurrence with the recorrmendation of the Board of Appeals; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is for the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VIILAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: That the property being the subject matter of Case No. 68-5A, being legally described as follows: Lots 1, 2, 3 and 4 in Maplewood Heights, being a subdivision of the East 15 chains of that part lying North of Railroad of the Southeast Quarter of Section 12 (except the Southerly 66 feet thereof) also of Block 26 in Busse's Eastern Addition to Mount Prospect, in the East half of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, currently zoned B-2 (Restricted Business District) under the Zoning Ordinance of the Village of Mount Prospect, which zoning classification shall remain subject to the following granted variations: (a) That the maximum height of the Building thereon shall not exceed 34 feet; and (b) That the floor area of the building thereon shall not exceed 23,850 feet; and (c) That evidence of title of the property lying imnediately north of the subj ect tract and zoned P-l remains under the exclusive control and ownership of the subj ect property herein to satisfy the necessary off-street parking requirements as set forth in Ordinance No. 2049 amending Section 20 of the Zoning Ordinance of the Village of Mount Prospect. (d) That the building shall be so constructed as to provide off-street parking facilities beneath the two (2) habitable floors. ,~ ,..-... ---- ~" Ii...M SECTION 2: That all requirements of the Village Code are applicable except those variations as specified in Section 1 heretofore mentioned. SECTION 3: That the Director of Building and Zoning of the Village of Mount Prospect is hereby directed to issue a building permit in accordance with the variations hereinbefore mentioned. SECTION 4: That the variation granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such vatiations is made an~ construction commenced within one year of the date said Ordinance becomes effective. SECTION 5: This Ordinance shall be in full force and effect from and after its passage and approval in the maImer provided by law. AYES: 6 NAYS: 0 PASSED this 19th day of March, 1968.
