HomeMy WebLinkAboutOrd 2071 04/16/1968 /.;J'_N""",<. ,~ /~ ~ ORDINANCE NO. 2071 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED ON THE WEST SIDE OF RAND ROAD BETWEEN THAYER AND HEN'RY STREErS WHEREAS, the Board of Appeals of the Village of Mount Prospect held a regular meeting on January 25, 1968 at the hour of 8: 00 P.M. in the Mount Prospect Village Hall pursuant to notice published in the Mount Prospect Herald on January 5, 1968; and WHEREAS, the Board of Appeals of the Village of Mount Prospect heard testimony presented under Case No. 68-lA pertaining to a request to operate an automobile sales agency on said property described hereinunder including the selling, storage and servicing of new and used automobiles which involved a land use variation, a lighting variation, a fence variation, and a sign variation; and WHEREAS, the Board of Appeals recorrnnended to the Judiciary Conmittee of the Board of Trustees of the Village of Mount Prospect to allow the variations on the use of the subject property for the use petitioned for; and WHEREAS, the Judiciary Committee of the Board of Trustees of the Village of Mount Prospect subsequently met on March 1, 1968, and considered the recommendations of the Board of Appeals under Case No. 68-lA; and WHEREAS, the Judiciary Conmittee recorrnnended to the Board of Trustees of the Village of Mount Prospect to allow the variations as presented; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is for the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT: SECTION 1: That the property being the SUbject matter of Case No. 68-lA, being legally described as follows: That oart of the North 1/2 of the Southwest 1/4 of the Southwest 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian lying West of Rand Road (excepting from said tract the West 193 feet thereof and also excepting the South 33 feet thereof) in Cook County, Illinois. is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-l (single family residence) which zoning classification shall remain subject to the following granted variations; (a) That the land described above shall include: The East 72 feet of the West 265 feet of the South 313 feet of that part of the North 1/2 of the Southwest 1/4 of the South- west 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, lying West of Rand Road (excepting therefrom the South 33 feet thereof) in Cook County, Illinois. obtained by petitioner and which tract shall be incorporated and made an integra;L part of the terms and specifications of this ordinance. (b) That the use of the said property may consist of the operation of an automobile sales agency, known as John Mufich Buick, including the selling, storage, and servicing of new and used automobiles. (c) That the building set-back line shall be not less than 30 feet from the property line abutting Rand Road, not less than 82 feet from the property line abutting Henry Street, and not less than 122 feet from the Westerly property line. (d) That the overall building height shall not exceed 21 feet. (e) That the total building area shall not exceed 33,035 square feet. I (f) That the northerly 33 feet of said property shall be dedicated to the Village of Mount Prospect for a public street, known as Thayer Street, and further the petitioner does agree not to contest a special assessment laid for the improvement of Thayer Street it and when such improvement shall occur. (g) That there shall be no ingress to or egress from said property from or onto Henry Street. (h) That there shall be public sidewalks installed in the roamer required by law and abutting the street dedication lines of Henry Street, Rand Road, and Thayer Street. (i) That there shall be constructed no more than two 24 foot drive- ways from Rand Road onto the said property, and each driveway so constructed shall be for both egress from and ingress to the said property, with full compliance with State of Illinois regulations pertaining to same. (j ) That there shall be deeded to the Village of Mount Prospect in fee simple the Westerly 10 feet of the subject tract subject to an easement upon the East 3 feet of said 10 feet for the purposes of maintaining and repairing fences. (k) That a fence shall be constructed upon the petitioner's property in compliance with following specifications: (1) The whole of said fence shall be composed of Ampress Solar Screen Block, Pattern No. 41, containing units 8 inches by 16 inches by 4 inches in size. (2) Said fence shall have a 4 foot height along the west 30 feet of petitioner's property abutting the Thayer Street property line and the west 320 feet of said property abutting Henry Street. (3) Said fence shall have a height of not less than 6 feet nor IIDre than 8 feet along the entire west property line ( as established by paragraph (j) above) approximately 594.93 feet and so constructed that it shall join the west termini of the two above mentioned sections of said fence. (1) There shall be such facilities for water detention and/or retention as may be approved of by the Village Engineer pursuant to the local ordinance. (m) That there shall be no use of any outdoor sound amplifier or sound equipment on said property. /~ I!':~"'" '-', .-. (n) That all ourdoor lighting shall be of a non-glare nature and shall not be aimed directly or indirectly at or upon surrounding property, and shall conform to the following standards: (1) The perimeter of said property (South, West and North) shall utilize not more than 12 Mercury Vapor fixtures on poles rot to exceed 12 in number so constructed that the overall height thereof shall not exceed 28 feet. (2) The South portion and Eastern perimeter of said property shall utilize not more than 50, 4 lamp, 8 foot, flouorescent lurninaire fixtures, and not more than 23 quartz lights, all 73 of which shall be arranged on poles not to exceed 24 in number and so constructed that the overall height thereof shall not exceed 14 feet. (3) The Southeast comer of said property shall utilize not more than 2 Baltimore fixtures using Mercury Vapor lamps and 2 quartz lights arranged on not more than one pOle and so constructed that the overall height thereof shall not exceed 28 feet. (4) The north storage area of said property shall utilize not more than 4 Baltimore fixtures using Mercury Vapor lamps arrang- ed on not more than one pole and so constructed that the over- all height thereof shall not exceed 28 feet. (0) That there shall be placed upon the building two sigps in the following roamer: (1) Eash of said signs shall read "John Mufich Buick". (2) Each of said signs shall have overall dimensions not exceeding 28 feet in width nor 2 feet in height. (3) Each of said sigps shall be single-faced with white plastic letters having interior double tube rear illumination. ( 4) Each of said signs shall be mounted to the canopy above the show-room, one on the southeast side of said show-room, and the other on the northwest side of said show-room. (p) That there shall be mounted to the canopy above the frOnt of the show-room facing northeast one single-faced sigp reading "Buick- Opel", and constructed of which plastic letters having interior double tube neon illumination, and which sigp shall have overall dimensions not to exceed 18 feet in width nor 2 feet in height. (q) That two single-faced Buick-Opel emblems shall be mounted to. the brick fascia of the northeast portion of the building and facing northeast, which emblems shall be constructed of colored plastics and have interior illumination and overall diameters not to exceed 4 feet. SECTION 2: That all requirements of the Village Code be applicable except those variations as specified in Section One heretofore mentioned. SECTION 3: That the Director of Building and Zoning of the Village of Mount Prospect is hereby directed to issue a building permit in accordance with the variations hereinbefore mentioned. SECTION 4: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variations is made and construction ~ ( ".-, - .~. . . conunenced within one year of the date said Ordinance becomes effective. SECTION 5: This ordinance shall be in full force and effect from and after its pUblication and approval in the manner provided by law.
