ORDINANCE NO. 2166 AN ORDINANCE AMENDING SEGrION 21.1108 AND ARI'ICLE VII OF THE BUILDING CODE ~ WHEREAS, the Building Conmi ttee of the Board of Trustees of the Village of Mount Prospect did neet at the Village Hall on June 11, 1969, at the hour of 8:00 P.M. and did discuss certain changes regarding fence requirements; and WHEREAS, the said Building Conmi ttee have reconmended to the President and Board of Trustees of the Village of Mount Prospect to adopt the said amend- nentsj and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the sane are for the best interests of the Village of Mount Prospect j NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPEGr, c<x)K COUNTY, ILLINOIS: SEGrION ONE: That Paragraph (c) of Section 21.1108 of Chapter 21, (The Building Code) of the Municipal Code of Mount Prospect of 1957 ,as amended, be and is hereby further amended to allow increased heights to 6 feet for fences surrounding swimming pools, so that the said paragraph (c) shall here- after be and read as follows: "(c) The fence and gates shall be at least four (4) feet six (6) inches but no greater than six (6) feet in height above the walk grade level and shall be constructed of a mininwn nurrber of 9 gauge woven wire mesh corrosion-resistant material." SEGrION TWO: That Article VII of Chapter 21 (The Building Code) of the Municipal Code of lVbunt Prospect of 1957, as amended, be and is hereby ammded in its entirety to incorporate regulations for fences sUrTounding swimming pools, so that the said Article VII shall hereafter be and read as follows: ARrICLE VII - FENCES SECrION 21.701: Height and Location (a) Fences not more than three (3) feet six (6) inches in height and with not less than 50% open area will be permitted in the Village of Mount Prospect as follows: (1) Along the interior or ~ar lot lines and entirely to the rear building line; (2) On corner lots, the fence shall be set back one foot from side street lines and entirely to the rear of the house. (b) Fences at least four (4) feet six (6) inches, but not greater than six (6) feet in height and with not less than 50% open area will be required in the Village of M:>unt Prospect provided they sUrTOUnd swimming pools other than swirmning pools having a raised deck at least 4' 6" above grade and may be placed as follows: (1) Along the perimeter of the pool walk areas; or (2) Along the perineter but within the building lines of such real property upon which it is located. ( c) In residential districts as defined by the Village of Iv'bunt Prospect Zoning Ordiance: A fence up to six (6) feet in height will be per- m1 tted if placed noi nearer to property lines than a building is permitted under the Zoning Ordinance of the Village of Mount Prospect, and provided that.^a~twenty-five (25) foot set-back is maintained from the rear lot line. (d) In a residential district, patio screening not to exceed six (6) feet in height nor eighteen (18) feet in length nor four (4) inches in width will be allowed nearer to the lot line than the building is permitted, provided: " - -2- /~, (1) It is to be located adjacent to or adjoining a patio; and (2) The permitee submits a letter of approval sigped by the abutting property owner. SECrION 21.702: Construction (a) Fences shall be so constructed as to have a smooth finish side facing towards the nearest lot line. (b) It shall be unlawful to erect or maintain anywhere within the Village of lVbunt Prospect a fence equipped with or having barbed wire, spikes or any similar device, or any electric charge sufficient to cause shock. (c) Fences surrounding swimming pools rust meet these additional specifications: (1) All fence posts shall be decay or corrosion resistant and all fence openings or points of entry to the pool area shall be equipped with gates, which gates shall be equipped with self- ClOSing and self-latching devices placed at the top of the gate and made inaccessible to small children. In the event such pool has a raised deck as indicated in paragraph (a) of Section 21.1108, all points of entry thereto shall be equipped with self-closing and self-latching devices placed at the top and made inaccessible to small children. (2) The fence and gates shall be a least four (4) feet six (6) inches but not greater than six \;6) feet in height above the walk grade level and shall be constructed of a mininum mmber of 9 gauge woven wire mesh cOrTosion resistant material. (3) If the fence construction required in this Section is constructed upon property lines, pursuant to a given variation, so as to completely enclose the yard area, such construction shall be con- sidered to meet the require:rrents of this Section. SEGrION 21.703: Nuisance Abatement Any fence which rra.y be erected or in process of erection, contrary to the provisions of this Chapter, shall be deemed a misance, and it shall be the duty of the Director of Building & Zoning to summarily abate the sane. SEGrION 21.704: Issuance of Permits The Director of Building & Zoning is hereby authorized to issue a permit for the erection of a fence provided: (a) Two (2) drawings or sketches of the proposed fence are submitted along with a properly completed building permit application; and (b) The proposed fence shall meet the requirements set forth in this Article VII of Chapter 21 herein. (c) It shall be unlawful to proceed with the construction or erection of BrrJ fence before a permit for such work has been obtained from the Building & Zoning Depart:rrent. SEGrION THREE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner pro- vided by law.
