HomeMy WebLinkAboutOrd 2167 07/01/1969 OPJ)INANCE NO. 2167 ORDIANANCE GRANTING A FRONT YARD VARIATION AT 704 WEST CENTRAL ROAD, Mr. PROSPEGr, ILLINOIS WHEREAS, the Board of Appeal of the Village of Mt. Prospect did meet at the Village Hall on the 27th day of March, 1969, at the hour of 8:00 P.M. and did hear a petition for a front yard variation under Case No. 69-l3A, pursuant to the proper legal notice published March 11, 1969; and WHEREAS, the. Board of Appeals of the Village of Mt. Prospect did hear the petition to add 15 feet to the total 139.05 foot width of an existing non- conforming use which is set back from lot line - 1 foot - 9 inches; and WHEREAS, the Board of Appeals of the Village of Mt. Prospect have reconnen- ded to the Board of Trustees of the Village of Mt. Prospect to grant the requested 23 foot - 3 inches - front yard variation; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mt. Prospect did meet on June 11, 1969, and did consider Case No. 69-l3A; and WHEREAS, the Building Comrni ttee of the Board of Trustees of the Village of Mt. Prospect have reconnended to the President and Board of Trustees that the variation requested under Case No. 69-l3A be granted because: 'lhere is a practical hardship upon the owner; the conditions are unique; the purpose of the variation is not based exclusively upon a desire to make money; the granting of the variation will not be detrirrental to the public welfare or injurious to other property; and the variation will not impair on adequate supply of light and air to adj acent properties; and WHEREAS, the President and Board of Trustees of the Village of Mt. Prospect do believe that the granting of the variation would not be detrimental to the imn:ediate neigtlborhood or to the residents of the Village of Mt. Pros- pect and that the best interests of the residents of the Village of Mt. Prospect will be sub served by the granting of this variatiol); NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VIILAGE OF IvDill-IT PROSPEGr, COOK COUNTY, IILINOIS. SEGrION ONE: That the property being the subject matter of Case 68-44A, being legally described as follows: The East 250.0 feet of that part of the East 1/2 of the Sot.1theast 1/4 of Section 33-42-11, lying South of the Chicago and North Western Railway, is currently zoned under the Zoning Ordinance of the Village of 1I'lt. Prospect as I-I (Ligtlt Industrial District) which zoning classification shall remain subject to the variation granted, herein; (a). That, that portion of the front yard fifty-two (52,), ffet to sixty- seven (67) feet East of the West lot line of the above - described tract be reduced to a mininum of one (1) foot - nine (9) inches. SEGrION TWO: That all requirements of the rv'bunt Prospect Building and Zoning Code shall be applicable except the variation noted in Section One heretofore nentioned. SEGrION THREE: That the Director of Building and Zoning of the Village of r.bunt Prospect is hereby authorized to issue a Building permit for the erection and construction of an extension of an existing building in ac- cordance with the variation herein before nentioned. SEGrION FOUR: That the variation\i~ted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction com- -2- menced within one year of the date said Ordinance becorres effective. SECTION FIVE: This Ordiance shall be in full force and effect from and after its p~sage and approval in the manner provided by law.
