HomeMy WebLinkAboutOrd 2182 09/16/1969 !~, - ORDINANCE NO. 2182 AN ORDINANCE GRANTING A VARIATION FOR PROPERrY SO LOCATED THAT IT FRONTS ON BOI'H THE SOurH SIDE OF GOLF ROAD AND THE WEST SIDE OF BUSSE ROAD. \-lHEREAS, the Board of Appeals of the Village of tlbunt Prospect held a regular meeting on July 24, 1969 at the hour of 8 :00 P.M. In the rlbunt Prospect Village Hall pursuant to notice published in the Prospect Day on July 7, 1969; and \llHEREAS, the Board of Appeals of the Village of Mount Prospect heard testimony presented under Case No. 69- 38A pertaining to a request to operate a shopping center with less than four (4) feet of parking area for each one (1) foot of floor area of shopping center build- ing, but rather with a three (3) foot to one (1) foot ratio; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Yount Prospect subsequently met on AUfSUst 13, 1969, and considered the recorrrnendations of the Board of Appeals under Case No. 69-38A; and \oJHEPEAS, the Board of Trustees of the Village of Mount Prospect recorrrnended to allow the variation for reasons that: (1) There is a practical hardship on the m-mer that the sub- division of this tract into several lots would necessitate several corresponding buildings rather than the move aesthe- tically desirable single building proposed; (2:)' The plight of the owner is due to unique circumstances in that he has agreed never to aggravate further the parking facilities on the subject parcel in that he will never allow more than 2,000 sq. ft. of public seating area serving establishments dispensing food or beverages for consumption on premises located on this parcel of land, since under the Zoning Ordinance an additional parking space shall be pro- vided for each 100 sq. ft. of such public seating area; and (3) The variation will not alter the essential character of the locality; and WHEREAS, the President and Board of Trustees of the Village of Iv:ount Prospect have reviewed the matter herein and have determined that the sane is for the best interests of the Village of IVlount Prospect. NOW, THEREFORE, BE IT OHDArNED BY Th"E PRESIDTh1'J:' A.ND BOARD OF TRUSTEES OF THE VIlLAGE OF MJUNT PROSPECI', COOK COUNTY, ILLINOIS: SECI'ION ONE: That the property being the subject matter of Case No. 69-3t1A, being legally described as: Lot One in the Golf-Busse Subdivision being a subdivision of part of Lot 6 in the Division of the Louis F. Busse Farm in the Northeast 1/4 of Section 15, Township 41 North, Bange 11, East of the Third Principal JV:eridian, in Cook County, Illinois; is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-3 (Business - Retail & Service) which zoning classification shall remain subject to the fOllowing granted variation: That the land described above shall include a minirrurn number of four hundred eip-,hty (480) ten (10 foot by twenty (20) foot parking spaces for vehicles, which spaces shall be in excess of all necessary driveways, lanes, ramps, and maneuvering areas. ,-, ,-. SECI'rON Tl!JO: That the total public seating areas of all establishments dispensing food or beverages for consumption on the premises of such establishments located on land described in Section One above be restricted and limited to a maxinwn of 2,000 square feet gross. SECI'IONTHREE: That all the requirements of the Village Code be applicable except that variation set out in Section One above and any such requirement which may be construed to be in conflict with the limitation set forth in Section Thro above. SECTION FQUH: That' the Director of Building and Zoning of the Village or l\'Iount Prospect is hereby directed to issue a building perini t in accordance with the variation and limitation hereinbefore mentioned. SECI'ION FIVE: That the variation granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction cornrrenced within one year of the date said Ordinance becorres effective. SECTION SIX: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
