III* CITIZENS TO BE HEARD rr rrrr%� i/�1�' IV* LIQUOR LICENSE REGULATIONS From time to time, the Board has discussed a variety of measures that they feel are important to our continued emphasis on controlling the sale of alcoholic beverages and the conduct of operations within our local liquor establishments. Attached is some research prepared by Michael Steklac in accordance with suggestions and comments made previously by various elected officials, In an, attempt to differentiate between a restaurant and a lounge operation, it is clear that we must tie a Class S Liquor License to the offering of a full service menu during all times that a lounge is open. Additionally, the Board may want to consider expressing in the Ordinance its intent that no more than 50% of a restaurant's revenues would be derived from the sale of alcoholic beverages. In this manner, a restaurant is more clearly defined and the lounge operation becomes incidental to the restaurant's operation. Our attorney advises us that with the issuance of 1987 Liquor Licenses, we can eliminate Class A Licenses which currently permit consumption on premises as well as package sales. The Village's current Ordinance requires owners and managers to be res.idents of the Village only when a License is issued to a partnership or an individual. In terms of issuance to corporationsr there is no requirement that the Manager be a resident. The Board will have to determine as a policy matter whether or not a restaurant manager will, in fact, exert better control than a non-resident,, I The law is still unsettled as to whether local government can ban "Happy Hours", although Village Counsel believes that Home Rule Communities do have the authority. Mr. Steklac has suppoft,ing research from the State of Massachusetts attached to the memo. Nevertheless, it may be best to watch the situation over the next months and re-examine it after a few Court cases are issued, While these proposals are significant changes to the Liquor Control Ordinance, they are not measures absent in other communities or in other states. If the Board desires to proceed with the redefinition of a Class S Liquor Licenselthe admi"nistration will have the necessary changes drafted by our general' counsel and available for a subsequent Village Board Agenda.
