Director of Economic Development Michael Sims, Staff Planner The minutes of the October 1, 1986 meeting were distributed immediately prior to the start of this meeting. ,"ince Commission members had not had the opportunity to review these, approval of said minutes was deferred until the next regular meeting . SUBDIVISIONS Substantial materia, relative to the Brentwood Subdivision i l.on (S imonsens ' Nursery) , was also distributed to the Commission members ,just prior to tonight's meeting. Since this item was on the agenda for this meeting, the Chairman called for a short recess to allow each member to read these papers, Se gra f l rye Drive Commissioner Velasco reiterated his question (from a prior meeting) about prior notification, to residents of the proposed vacation of Seraftne Drive. Mr. Fritz excused himself so that he could check the degree of not i f scat ion that had been offered. Upon his return, he stated that public notification had been issued for a ZBA meeting to consider a variation request by the Sunrise Pancake House. (Sunrise had requested this variation based upon the impending street vacation), The variation request had also been considered, and approved, by the Village Page Two PLAN COMMISSION MINUTES October 15,, 1986 Board. ( sec . note : the vacation had not yet been considered by the Board), After some discussion, it became apparent that prior notification, specifically related to Just the Serafine vacation, had not been given to residents* Mr. Mc Govern asked If we are creating a precedent for notifica- tion. otifica►-- tion. Mr. Kloster countered that the Development Code does not require such notification. Mr* Borrelli asked If we might wart to amend the Code, Mr. Boege recommended deferral of action on this vacation request until notUice was given to residents. Mr Kloster offeredsuggested that, the request 'be reviewed on its, meritsO, Mr. Fritz o"courtesyof to residents prior to action being taken by the Board. It was also recommended that a sign be used to notify residents of proposed variations from the Develop- ment Code and the Chairman requested Development Code Committee Chariman to evaluate this suggestion and to report on it a future Plan Commission meeting. Mr. Boege moved that notification be given to residents affected by the serafine Drive vacation prior to the time of consideration by the Village Board,; it was seconded by Mr. Kloster* 8 members 'doted Aye; there were no Nay's • The Chairman declared the motion carried. Mr. Kloster moved, and Mr. McGovern seconded, that the Commission approve the serafine Drive vacation from Rand Road to Albert Street, '',the vote was 6 Aye and 2 Nay. The Chairman declared the motion pas sed , The petitioner was represented by Robert Moore, attorney for ;harry McKone of McLaw & Associates. A Mr. Allen owns the entire tract and has his home on Lot 1. The entire tract is RX and a change to Rl is requested. Two lots will be subdivided into three lots. Mr. Boege moved, and Mr. Velasco seconded, that the Commission approve the resubdivision and authorize the Chairman and secretary to sign the Plat of Resubdivision » All members voted Aye and the Chairman declared the motion carried. Brentwood Subdivision Several persons were present representing the ;petitioner Tsolinas/Moreno & Associates, Inc. including its vice--president Salvatore Cipriano and its attorney Charleen A. Reinhold. No homeowner's or other residents were in attendance. Petitioner was asking for a change in the Comprehensive Code Classification from Il ;dor the entire 35.48 acre site to g3 for 4.52 acres and R1 ;for the balance* There were further requests Page 'Three PLAN COMMISSION MINUTES OCTOBER 15, 1986 for numerous Development Code modifications. The architects, builders and petitioner described many aspects of this project including the flood plain problem, storm water detention, yard/parking requirements, fencing and 1a nds -sap ing, proximity to train tracks, coverd bridge access and a Homeowner's Association that would be responsible for maintenance on entryways. The builder also discussed his variation requests and the reasons for such including the many alternatives that had been evaluated, It was pointed out that the 'ZBA► had rejected a 1 l of the requested variations., Commissioner 'Velasco moved that acceptance of single family residence class and the B3 use be ,accepted predicated upon the PUD plan as proposed by the developer. Mr. Kloster seconded. Seven members voted Aye ,and one Nay. The Chairman declared the motion carried. The Chairman asked the dissenter, Mr. Borrelli, if he cared to ,share his reasons for rejection with the Commission. Mr. Borrelli stated that while he was not opposed to the land use reclassifi- cation, eclassification, he was concerned about the adequacy of the builder's plan .for roping with the McDonald Creek ,flood plain issue and also with the proposed density and configuration of the single family sites, especially in view of all the Cade modifications required to accomadate the proposed layout. Mr. Velasco moved, and Mr. Kloster seconded, that the Commission approve the reclassification of this property from Il to B3 and R1, as requested by the petitioner, The vote was 8 Aye and 0 Nay; the Chairman declared the motion carried, A► summary of the Development Code modifications is set forth below; these had been reviewed and agreed to by the Village Engineer. 1.. Lot layout not held to requirement that cul-de-sac lots shall have lot lines radial to the center of the cul-de-sac sacs Mr. ;Boege moved, and Mr . Velasco ,seconded, that a composite approval of the Development Code modifications, as set forth above, be granted for the Brentwood Subdivision. The vote was 8 Rye and o Nay, and the 'Chairman declared the motion carried. COMMITTEE REPORTS 1. Community Development -- No Report 2. Comprehensive Plan - Chairman McGovern reported that the Committee had completed their review and revision of the Plan, Mr. B ims will collate this work and put it Into a draft. form which will first rho to the Plan Commission, then to BDDRC, and then revised, as needed. Public hearings will be held and a f ina l draft of the Plan will be submitted for approval. 3. Development. Code No Report 4. "Tent Amendment No Report OLD BUSINESS 1.
