HomeMy WebLinkAboutOrd 4877 07/15/1997 ORDINANCE NO. 4877 AN ORDINANCE AMENDING ARTICLE XV ENTITLED "TELECOMMUNICATIONS TAX" OF CHAPTER 8 OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS Passed and approved by the President and Board of Trustees the 15th dayof July , 1997 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 15th dayof July , 1997. 7/15~97 ORDINANCE NO. 4877 AN ORDINANCE AMENDING ARTICLE XV ENTITLED "TELECOMMUNICATIONS TAX," TO CHAPTER 8 OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS WHEREAS, the Village of Mount Prospect is a home rule municipality as defined and set forth in the Constitution of the State of Illinois and by the provisions thereof is empowered to enact such legislation pertaining to its local governmental affairs as is deemed necessary in the best interest of the Village; and WHEREAS, the corporate authorities did adopt a Telecommunications Tax; and WHEREAS, the corporate authorities of the Village of Mount Prospect have determined that, in order to provide funds to resurface or reconstruct streets within the corporate limits of the Village, the Telecommunications Tax should be increased. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That subsection A of Section 8.1503 entitled "Tax Imposed" of Chapter 8 of the Village Code of Mount Prospect, as amended, is hereby further amended by deleting said Section 8.1503.A in its entirety and substituting therefor the following; so that hereafter said Section 8.1503.A shall be and read as follows: " 8.1503. Tax Imposed The Telecommunications tax shall be imposed as follows: 1. Effective as of and commencing October 1, 1997 through and including September 30, 2004, a tax is hereby imposed upon: a. The act or privilege of originating in the Village or receiving in the Village intrastate telecommunications by a person at a rate of three and three tenths percent (3.3%) of the gross charge for such telecommunications purchased at retail from a retailer; and b. the act or privilege of originating in the Village or receiving in the Village interstate telecommunications by a person at a rate of three and three tenths percent (3.3%) of the gross charge for such telecommunications purchased at retail from a retailer. 2. Effective as of and commencing October 1, 2004 and continuing until further order of the Board of Trustees, a tax is hereby imposed upon: a. The act or privilege of originating in the Village or receiving in the Village intrastate telecommunications by a person at a rate of two percent (2%) of the gross charge for such telecommunications purchased at retail from a retailer; and b. the act or privilege of originating in the Village or receiving in the Village interstate telecommunications by a person at a rate of two percent (2%) of the gross charge for such telecommunications purchased at retail from a retailer." SECTION TWO: That this Ordinance shall be effective October 1, 1997. elecommunications Page 2 of 2 SECTION THREE: That this ordinance shall be in full force and effect after its passage, approval and publication in pamphlet form in the manner provided by law.
