ORDINANCE NO. 4879
AN ORDINANCE GRANTING A CONDITIONAL USE FOR PROPERTY
COMMONLY KNOWN AS 199 WEST RAND ROAD (XPRESS-O INTERNATIONAL)
WHEREAS, Francine Piehl (hereinafter referred to as Petitioner) has filed a petition for a
Conditional Use with respect to property located at 119 West Rand Road, (hereinafter
referred to as the Subject Property) and legally described as follows:
Bartmann 199 Road Subdivision of Part of the Southeast 1/4 of the
Southwest 1/4 of Section 27, Township 42, Range 11, Recorded April 18,
1985 as Document Number 27516851; and
WHEREAS, Petitioner seeks a Conditional Use to permit a drive-thru facility in conjunction
with the operation of a coffee shop facility; and
WHEREAS, a public hearing was held on the request for Conditional Use being the
subject of ZBA Case No. 15-97 before the Zoning Board of Appeals of the Village of Mount
Prospect on the 26th day of June, 1997, pursuant to proper legal notice having been
published in the Mount Prospect Journal on the 6th day of June, 1997; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations
to the President and Board of Trustees in support of the request being the subject of ZBA
15-97; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
given consideration to the request herein and have determined that the same meets the
standards of the Village and that the granting of the proposed Conditional Use would be
in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILI_AGE OF MOUNT PROSPECT, COOK COUN1-Y, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by
the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect
do hereby grant a Conditional Use to permit a drive-thru facility on the Subject Property,
which drive-thru facility is in conjunction with the operation of a coffee facility, as shown
on the Site Plan attached hereto and hereby made a part hereof as Exhibit "A".
SECTION THREE: That the Village Clerk is hereby authorized and directed to record a
copy of this Ordinance with the Recorder of Deeds.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
