Present at the meeting were: Mayor Gerald Farley; Trustees Ralph Arthur, Mark Busse, Timothy Corcoran, Leo Floros, George Van Geem and Theodore Wattenberg. Also present at the meeting were Village Manager John Fulton Dixon and Director of Planning and Zoning David Clements. The f" st.-item of discussion was the parcel of land at the northwest corner of Kensington and The owner of the property indicated to staff he was contemplating suit against the Village since he purchased the property based on the assumption that the underlying zoning was B-4. After the developer had gone through the Hearing process before the Zoning Board of Appeals for minor variations,, it was discovered that there was an unrecorded PUD on this parcel which would mean that the entire process that was used would be null and void. The question was raised whether or not the FUD had existed on the parcel since it had not been recorded. Direction to staff was to lessen the impact of the car wash. The second item of potential litigation concerned whether or not the Village wished to file a suit against the City of Des Plaines over billboards particularly the billboard at Dempster and 83. After extensive discussion, it was felt that filing of a suit was not action the Board wished to take at this time. A Motion was made by Trustee Leo Floros and Seconded by Trustee Mark Busse to adjourn the meeting at 10:24 p.m. U JOHN FULTON XON Village Manager JFD/rcw MAYOR GERALD L FARLEY TRUSTEES RALPH W.
