ORDINANCE NO. 2228 AN ORDINANCE AMENDING SECTIONS 1 AND 6 OF THE ZONING ORDINANCE OF THE VIILAGE OF MOUNT PROSEPCT -,-- S, pursuant to proper legal notice, the Plan CoIl1Tlission of the Village of Mount Prospect at the hour of 8:00 p.m. did hold public hearings in the Village Hall on November 21, 1969, under Case No. 69-36P, and December 19, 1969, under Case No. 69- 38P; and WHEREAS, the Plan COJmlission recomnended to the President and Board of Trustees of the Village of Mount Prospect approval of changes to Section 1 and Section 6 of the zoning ordinance under the said Cases 69- 36P and 69- 38P, respectively; and WHEREAS, the Judiciary Conmittee of the Board of Trustees of the Village of Mount Prospect have on February 12, 1970, reviewed the subject matter herein mder Cases 69-36P and 69-38P,; and WHEREAS, the said Judiciary Conmittee has recomnended to the President and Board of Trustees of the Village' of Mount Prospect concurrence with the recomrendations of the Plan Commission under Cases 69-36P and 69-38P; and WHEREAS, the President and Board of Trustees of the Village of Mount Prosepct have reviewed the subj ect matter herein and have determined that the sane is in the best interests of the Village of Mount Prosepct; NOW, THEREFDRE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Subsection B of Section 1 of the Mount Prospect Zoning Ordin- ance, as anended, be and is hereby further amended by a~irlg thereto a new para- graph 6 restricting one train building or one main use to any given lot, so that the said Subsection B shall hereafter be and read as follows: "(B) Scope of Regulations. Except as provided by this ordinance and except after obtaining written permission from the Director of Build- ing and Zoning it shall be unlawful in the Village of Mount Prosepct: 1. To establish any use of a bulding, structure, or land, either by itself or in addition to another use. 2. To expand, change, or re-establish arw non-conforming use. 3. To erect a new building or structure or part thereof. 4. To rebuild, structurally alter, add to, or relocate any building or structure or part thereof. 5. To reduce the open space or lot area below that required for a building or structure or to include any part of such required open space or lot area as that required for an adjoining building or structure. 6. To construct more than one main building upon a lot or to occupy any lot by more than one main use, unless such lot is improved as a Plamed Unit Development under Section 5.1 hereunder." /~ ~" ~ ~ ECTION TWO: That Section 6 of the Zoning Ordinance of the Village of Mount Prospect, as amended, be and is hereby further amended in its entirety by making ertain mecharifcal changes therein, so that the said SectiOn 6 shall hereafter e and read as follows: "Section 6. R-X District: A. In the R-X Districts the only uses which may hereafter be established are: 1. Single-family residence on a lot not less than 17,500 square feet in area. 2. Public school, elementary and high, or parochial school without dormitory accorrmodations and having a curriculum equivalent to a public elementary or high school. 3. Church. 4. Village, park, library or museum excluding corrmercial enterprises therein. B. All uses excluded from the R-l Distirct are also excluded from the R-X District. c. In District R-X the minimum dimensions of yards shall be as follows: 1. FRONT YARD. Any building or structure hereafter shall be set back from the front line at least 40 f'eet. Ex- ceptions: (a) open steps and terraces, (b) eaves, chilTneys, bay windows and i other ordinanary proj ections extending into such yards not more than 18 inches. , 2. SIDE YARD. The minimum side yard for Distzoi-ct R-X shall be the same as pr.ovided for in the R-l Districts. 3. REAR YARD. The minimum rear yard requirements for Dis- trict R-X shall be the sane as are now required in the R-l Distircts. D. 'Ihe rnaxirm..m1 Floor Area Ration (F .A.R.) in the R-X Distirct shall be 0.2."
