HomeMy WebLinkAboutOrd 2242 09/01/1970 'I ,,~ ~ - ,~, ORDINANCE NO. 2242 AN ORDINANCE GRANTING A SIDE YARD REQUIREMENT VARIATION FOR PROPERTY LOCATED AT 400 NORTH PINE STREEI' 5 MOUNT PROSPECT 5 ILLINOIS WHEREAS, the Board of Appeals of the Village of Mount Prospect did meet on the 25th day of June and the 23rd day of July, 19705 at the hour of 8: 00 p.m. at the Mount Prospect Village Hall and did hear Case No. 70-l4A pursuant to proper legal notice; and WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear this request for a side yard variation to allow the petitioner to expand his residence to within ten (10) feet of his side property line of the lot legally described herein below, and WHEREAS 5 the Board of Appeals of the Village of rllount Prospect recom- mend to the President and Board of Trustees the approval of this request under Case No. 70-l4A for reasons that: (1) There is a practical difficulpy and particular hardship on the petitioner; (2) The purpose of the variation is not based exclusively upon a desire to rrake money; (3) The conditions upon which the petition for this variation is based are unique in that the property is located at an intersection whereon the other corner lots presently have side lot lines of ten(lO) feet or less; ( 4) The granting of the variation will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential chal~acter of the locality; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on August 26, 1970, at the hour of 8:00 p.m. and did consider Case No. 70-14A and did recommend to the President and BOard of Trustees concurrence with the reconrnendation of the Board of Appeals that the variation herein be granted; and WHEREAS, the President and Board of Trustees of the Village of Mount Proppect have reviewed the matter herein and have determined that the same is for the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 70::l4A5 being legally described as follows: Lot 59 in Roy Berry Co.' s 1st addition to Castle Heig,hts5 being a subdivision of the South half (1/2) of the Southeast quarter of the North 95.02 feet of East half (1/2) of the Southwest quarter, all in Section 34, Township 42 North 5 Range 11, East of the Third Principal Meridian, in Cook County, Illinois; ,....-, -, ,~ ~, ORDINANCE NO. 2242 (Continued) is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R...l (Single Fa.JTIily Residence) which zoning classification shall remain in effect Subject to the variation granted herein: (a) That the side yard abutting the southemmost lot line of the subj ect property may be reduced to ten (10) feet. SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variation noted in Section One heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accordance with the .variation hereinbefore mentioned. - SECTION FOUR: That the variation granted by this Ordinance shall be null and voia and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction cOI!1Irenced wi thin one year of the date said Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
