HomeMy WebLinkAboutOrd 2216 02/03/1970 ,-, ~ ORDINANCE NO. 2216 AN ORDINANCE GRANTING A PARKING VARIATION FOR PROPERrY LOCATED AT 209 SOUTH MAIN STRFET WHEREAS, the Board of Appeals of the Village of JVflOunt Prospect did hold a public hearing on January 9. 1970, at the hour of 8:00 p.m. in the Mount Pros- pect Village Hall pursuant to notice published in a newspaper of general circu- lation within the Village of Mount Prosepct on [;ecember 24. 1969; and 1tJHEREAS. the Board of Appeals of the Village of r."iount Prospect did hear testi- mony presented under Case No. 70-2A pertaining to a request to construct at 209 S. Main Street a two story building with only fifteen (15) parking spaces instead of twenty-two (22) spaces as presently provided by ordinance; and WHEREAS, the Board of Appeals recorrrnend to the Building Corrmi ttee of the Board of Trustees of the Village of Mount Prospect to allow the variation petitioned for because: 1. There is a practical hardship on thepetitioner. since at the tine the property was rezoned to its present zoning classi- fication. parking requirenents were less stringent; 2. The purpose of the variation is not based exclusively upon the desire to make money; 3. The granting of the variation will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS, the Building Corrmittee of the Board of Trustees of the Village of Mount Prosepct subsequently net on January 14, 1970, and considered the re- commendation of the Board of Appeals under Case No. 70-2A; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of r."iount Prospect; NaN. THEREFORE. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSEPCl', COOK COUNTY. ILLINOIS: SECTION ONE: That the property being the subj ect matter of Case No. 70-2A be- ing legally described as follows: "lot 4 in Block 1 in JVeier's Addition to Mount Prospect in the Northwest quarter of Section 12, Township 41 North, Hange 11, East of the Third Principal IVeridian;" is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-2 (Business - Office District). which zoning classification shall remain subject to the following granted variations. A. That the land described above may include the construction and erection of a two story office building according to the plans attached hereto and made a part hereof, the basenent of which ~. ~ -., B. That only fifteen (15) parking spaces need be provided to serve the above-described building. SECI'lON' TWO: That all of the requirements of the Village Code of Mount Prospec be applicable except those variations set out in SECI'rON ONE above. SECI'rON THREE: That the Director of Building and Zoning of the Village of Moun Prospect is hereby authorized and directed' to issue a building permit in acc- ordance with the variations and limitations hereinbefore mentioned. SECI'rON FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction commenced within one (1) year of the date said Ordinance becomes effective. SECI'rON FIVE: That this Ordinance shall be in full force and effect from and after its passage t approval, and publication in the manner provided by law.
