I, i,l jl -I I' , ORDINANCE NO. 2307 AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERlY LOCATED AT III "'JEST CENTRAL ROAD, l\f[()UNT PROSPECT, ilLINOIS WHEREAS, the Board of Appeals of the Village of Mount Prospect did conduct a special meetinp: on rvray 6, 1971, at the hour of 8: 00 P.M. in the Mount Prospect Village Hall pursuant to notice published in the Mount Prospect Herald on April 20, 1971; and WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear testimony presented under Case No. 71-15A pertaining to a re- quest to construct at III West Central Road a building addition which would extend the existing building which was constructed pur- suant to rear yard variation; so that an additional twenty (20) by thirty-nine (39) foot rear yard area would be improved with the proposed structure; so that the entire improverrents located at III West Central, both the existing and the proposed structures, would provide twenty-one (21) parking spaces instead of twenty-four (24) spaces as presently provided by ordinance; and WHEREAS, the Board of Appeals has recorrmended to the Building Com- mittee of the Board of Trustees of the Village of Mount Prospect to allow the variations petitioned for because: (1) There is a practical difficulty and particular hardship on the petitioner, since sufficient land to deprive the petitioner of at least one (1) parking space will be ded- icated to the Village of Mount Prospect for pUblic right- of-way purposes; (2) The purpose of the variation is not based exclusively on a desire to ITEke rroney; (3) The granting of the variation will not be detrirrental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on May 26, 1971, and considered Case No. 71-15A and has reco!Illrended that the President and Board of Trustees concur with the Board of Appeals to grant these variations; and \IJHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matters herein and have determined the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDEN'l' AND BOARD OF TRUSTEES OF THE VILLAGE OF mUNr PROSPECT, COOK COUNTY, IILINOIS: SECTION ONE: That the property being the sub<iect matter of Case No. 71-15A, being legally described as follows: Lot 1 in Block 2 in Busse and Wille's Resubidvision in Mount Prospect in the West 1/2 of Section 12, IJ.bwnship 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-3 (Business - Retail and Service), which zon- ing classification shall remain subj ect to the variations granted herein ; (a) That no rear yard abutting the westerly lot line of the subject property need be maintained. (b) That twenty-one (21) ten (10) foot by twenty (20) foot paved off-street parking spaces need be provided upon the subject property instead of the twenty-four (24) ten (10) foot by twenty (20) foot parking spaces re- quired by ordinance to serve the existing building with its proposed addition. SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variations noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized and directed to is- sue- a building permit in accordance with the variations and limit- ations hereinbefore mentioned. SECTION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction commenced within one (1) year of the date saitrOrdinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and pUblication in the manner provided by law.
