HomeMy WebLinkAboutOrd 2289 03/02/1971 ORDINANCE NO. 2289 AN ORDINANCE AMENDING PORTIONS OF THE MOUNT PROSPECT BUILDING CODE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VIILAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That paragraph 2 of subsection (a) of Section 21.103 of Chapter 21 (The Building Code) of the Municipal Code of Mount Prospect of 1957, as amended, be and the san:e is hereby further curended to pro- vide for the installation of factory-built refractory lined, Under- writers Laboratory approved chimneys in certain construction; so that hereafter the said paragraph 2 in subsection (a) of Section 21.103 shall hereafter be am read as follows: "2. The following exceptions to the 1970 edition of the BOCA BASIC BUILDING CODE and amendments thereto shall contrOl where applicable or where in conflict with the said BOCA CODE. (a) Deletions: Section 128.0 of Article 1; and the entire Articles 10, except for Section 1007 therein; 11; 14; 15; 16; 17; and 18 of the BOCA BASIC BUILDING CODE as adopted in this Section are hereby \delet'ed' from this Chapter 21 of the Municipal Code of the Village of Mount Prospect. (b) Changes: (1) Table 6 is amended and revised in part as foll~lS: Heigpts The height limits for the respective types of construction and occupancy groups are hereby changed as indicated below: Type of Construction Occupancy Group Height . (11) PRarECTION TO EXTERIOR WALL OPENINGS The first paragraph of Section 916.0 shall be changed by deleting the words "more than three (3) stories or forty (40) feet in height." (111) PRarECTION TO COMMUNICATIONS THROUGH FIRE WALLS Sections 908.3 and 908.4 are revised so as to require a three (3) hour automatic or self-closing fire door approved for Class A openings on each side of every opening in a fire wall. I I I I j _ __ _L_ (lV) THICKNESS AND FIRE RESISTANCE OF EXTERIOR AND FIRE WALLS The title of Section 867.0 is hereby revised by deleting the word "Solid." New paragraphs, identical to Section 913.7 (b) and (c) of the National Building Code, 1967 Edition, are hereby added to Section 867.0. Sections 907.0 through 907.4 are hereby revised to be identical to Sections 800.1 to 800.6 of the National Building Code, 1967 Edition. In Table 5, Item 3, Fire Walls, the specified fire resistance ratings are omited and a note reading as follows is inserted: "Fire walls shall be constructed as specified in Section 907.0." (V) CHIMNEY, VENTS, HEAT PRODUCING APPLIANCES, B."lJ:lC. The Code for the installation of heat producing appliances, heating, ventilation, air conditioning, blower and exhaust systems, recomnended by the American Insurance Association, including appendices is hereby adopted to replace Articles 10 and 11; except that Section 1007 shall be amended to read as follows: 'Factory-built chimneys shall be allowed in two (2) or more- story commercial, industrial, and multi- family residential buildings -- provided such factory-built Chimney shall be refractory-lined and shall have been currently listed by the Underwriter's Laboratories and then such factory- built chirmeys shall be installed in accordance with the conditions of the listing and the manufacturer's instructions.' (VI) FIRE LIMITS RESTRICTIONS Section 304.0 is hereby revised to prohibit unpro- tected non-combustible Type 2C and wood fran:e '!Ypes 4A and 4B construction within Fire District No.2, except as provided in Section 400.6 of the National Building Code. (VII) ELEVATOR CONSTRUCTION Article 16 is hereby revised to include provisions for the construction of all passenger type elevator equiprr:ent, all passenger elevator cabs and door openings shall be of a size large enougtl to accept a standard portable ambulance cot in its horizontal position. I SECTION TWO: That subsection (e) of Section 21.204 of Chapter 21 (The Building Code) of the Mtmicipal Code of Mount Prospect of 1957, as amended, be and the san:e is hereby further anended by substituting the word "may" for the \'lord "shall" in the last line of the first sentence, so that hereafter the said subsection (e) of the said Section 21.204 shall hereafter be and read as follows: n(e) Whenever an application for a permit to construct or alter a building or structure wi thin the Village is made and the Architectural Commission finds that the proposed building or structure is of such value, deSign, material, or location that it vlill result in a substantial irnpairrr:ent or destruc- tion of value in neighboring real estate owned by the inhabi tants of this Village and if it further finds that the use of the particular design, material, or location proposed, or substantially similar ones, is not reasonably essential to the developrr:ent of the property proposed to be built or altered, the Director of Building and Zoning may refuse to issue the penni t. Any appeal from such decision shall be made in accordance with Article XIII of this Chapter." Ii SECTION THREE: That this ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by iaw.
