MAYOR'S REPORT JULY 4TH Mayor Farley and members of the Board complimented everyone involved with providing an enjoyable July 4th parade and celebration. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD ZONING ISSUES Bill Reddy, 105 South Elm. Street expressed concern relative to granting variations from the Zoning Ordinance and the fact that ~-~ hardships should be required in order for a variation to be granted. OLD BUSINESS ZBA 10-Z-94 & ZBA 10-Z-94 and ZBA 11-CU-94, 350 North Wolf Road ZBA 11-CU-94 The Petitioner informed the Village that their request for a 350 N. WOLF ROAD convalescent home had been presented to the State of Illinois for a determination as to whether a Certificate of Need would be issued. The State of Illinois denied the request as well as the Petitioner's appeals from that. denial, therefore the Petitioner is withdrawing the requests being the subject of ZBA 10-Z-4 and ZBA 11-CU-94. NEW BUSINESS ZBA 18-V-94 ZBA 18-V-94, 1505 Barberry Lane 1505 BARBERRY The Petitioner is requesting a variation to allow a minimum side yard setback of 5 feet, instead of the required 9.5 feet, to allow an attached garage addition. The Zoning Board of Appeals recommended denying this request by a vote of 4-3. The Petitioner stated that she and her family purchased and moved into this home a year ago. She also stated that she called the Police Department pdor to purchasing the home to make sure.that her husband's 8 foot wide, 10 foot high, 20 foot long panel truck used to transport produce and restaurant supplies would be allowed to park in the single family district. The Petitioner stated that she was informed that the vehicle could park in the driveway, however, since that time the Zoning Ordinance was amended and this vehicle is not allowed in a residential district, therefore the Petitioner wants to build a garage in order to house this truck. The garage being proposed would need a garage door 11 feet in height. Mr. Rozek, 1409 Barberry Lane, expressed opposition to the size of the garage and height of the door necessary to house this large vehicle. Members of the Board expressed concern relative to the size of this vehicle and the size of the garage that would be necessary to house it. Trustee Clowes, seconded b~' Trustee Skowron, moved to concur with the recommendation of the Zoning Board of Appeals and deny the variation requested in ZBA 18-V-94. Upon roll call: Ayes: CIowes, Hoefert, Henddcks, Skowron, VVilk$ Nays: None Motion carried. The Board instructed the administration not to enforce the Code for a period of 3 months in order to allow the Petitioner to make alternate arrangements to park this vehicle. Page 2 - July 5, 1994 Trustee Hoefert asked that the Board review that section of the Village Code governing the size and/or weight of vehicles permitted in residential districts, noting the former limitation was 1-1/2 tons (3,000 lbs) and the present limit is 8,000 lbs. ZBA 24-V-94, 20 North Marcella ZBA 24-V-94 The Petitioner has withdrawn his request for a variation to allow 20 N.MARCELLA a circular driveway, resulting in a front yard lot coverage of 45% rather than the maximum 35% allowed. The Zoning Board of Appeals had recommended granting this request by a vote of 5-2. ZBA 25-V-94, 703 West Milburn ZBA 25-V-94 The Petitioner is requesting a variation to allow a shed to be 703 W. MILBURN located two feet from the interior side property line, rather than the required 5 foot minimum. The Zoning Board of Appeals recommended granting this request by a vote of 7-0. Trustee Clowes, seconded by Trustee Wilks, moved to concur with the recommendation of the Zoning Board of Appeals and grant the variation requested in ZBA 25-V-94. Upon roll call: Ayes: Clowes, Skowron, Wilks, Farley Nays: Hoefert, Hendricks Motion carried. An Ordinance will be presented for first reading at the next regular meeting on July 19th. ZBA 28-V-94, 1418 East Emmerson Lane ZBA 28-V-94 The Petitioner requested a variation to allow a shed 16' x 18', rather than the permitted 10' x 12'. At the request of the Zoning Board of Appeals, the Petitioner reduced the size of the shed being requested for 12' x 14', with a 14' x 16' pad. The Zoning Board of Appeals recommended granting this request, as amended by a vote of 7-0. The Petitioner noted that he wants a I foot pad around the shed in order to prevent water damage. Trustee Clowes, seconded by Trustee Wilks, moved to concur with the recommendation of the Zoning Board of Appeals and grant the amended request for a variation to allow a 12' x 14' shed with a 14' x 16' concrete pad. Upon roll call: Ayes: Clowes, Hoefert, Skowron VVilks Nays: Hendricks Motion carried. An Ordinance will be presented for first reading at the next regular meeting on July 19th. The annual financial report for the Mount Prospect Public Library LIBRARY:1993 for 1993 was presented. FINANCIAL REPORT Page 3 - July 5, 1994 Trustee Skowron, seconded by Trustee Hoefert, moved to acknowledge receipt of the 1993 Financial Report for the Mount Prospect Public Library. DONATE 1966 An Ordinance was presented for first reading that would authorize the FIRE DEPT Village to donate the 1966 Chevrolet Fire Department Pumper to the PUMPER Ewing, Illinois Fire Protection District. This piece of equipment is no longer useful or necessary to the Village. Trustee Hoefert, seconded by Trustee Skowron, moved to waive the rule requiring two readings of an Ordinance. ORD.NO. 4654 Trustee Hoefert, seconded by Trustee Skowron, moved for passage of Ordinance No. 4654 AN ORDINANCE AUTHORIZING THE DISPOSAL OF CERTAIN PERSONAL PROPERTY OWNED BY THE ~'~ VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Clowes, Hendricks, Hoefert, Skowron, . Wilks Nays: None Motion carried. DONATE T.V. An Ordinance was presented for first reading that would authorize the CAMERAS Village to donate 3 T.V. cameras to School District 57. Trustee Hoefert, seconded by Trustee Skowron, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: Ayes: Clowes, Hoefert, Skowron, Wilks Nays: Hendricks Motion carried. Page 4 - July 5, 1994 An Ordinance was presented for first reading that would amend AMEND. CH. 24 Chapter 24 entitled "Fire Prevention Code" to include Article VII of the BOCA Property Maintenance Code in the local Village · regulations. Trustee Wilks, seconded by Trustee Clowes, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: Ayes: Clowes, Hoefert, Skowron, Wilks Nays: Hendricks Motion carried. Trustee Wilks, seconded by Trustee Clowes, moved for passage ORD.NO. 4656 of Ordinance No. 4656 AN ORDINANCE AMENDING CHAPTER 24 ENTITLED "FIRE PREVENTION CODE" OF THE VILLAGE CODE Upon roll call: Ayes: Clowes, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion carried. A recommendation was presented to accept the improvements IMPROVEMENTS: ,'"' installed in conjunction with the development of the RecPlex, REC PLEX 420 West Dempster Street. Trustee Wilks, seconded by Trustee Clowes, moved to accept the improvements'installed in conjunction with the development of the Mount Prospect Park District RecPlex building, 420 West Dempster Street. Upon roll cell: Ayes: Clowes, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion carded. The 2nd reading of the Ordinance amending Chapter 13 in its AMEND CH.13 entirety (Alcoholic Liquor Dealers) was being revised and will be presented to the Board at the next Committee of the Whole meeting on July 12th. The final draft of the Ordinance will be presented to the Village Board for adoption in the near future. VILLAGE MANAGER'S REPORT Village Manager Michael E; Janonis presented the wage FIRE DEPT. agreement with the Firefighters' Association which was WAGE negotiated and which agreement Mr. Janonis recommended the AGREEMENT Village Board approve. It was noted that the wge agreement was for a three year period and resulted in an approximate 3% salary increase. Trustee Clowes, seconded by Trustee Wilks, moved to approve the wage agreement between the Village and the Firefighters° Page 5 - July 5, 1994 Association, which agreement is for the period 1994 through 1997. HISTORICAL The request to waive bidding procedures and authorize a contract for SOCIETY: a fire suppression system in the Historical Museum Annex located FIRE SUPPRESSION at 101 South Maple Street was withdrawn. Mr. Janonis stated that the Historical Society can enter into contracts and does not need to involve the Village. BUDGET AMENDMENTS An Ordinance was presented for first reading that would amend the budget for fiscal year 1993/94. Trustee Hoefert, seconded by Trustee Skowron, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: Ayes: Clowes, Hoefert, Skowron, Wilks Nays: Hendricks Motion carried. ORD.NO. 4657 ~rustee Hoefert, seconded by Trustee Skowron, moved for passage of Ordinance No. 4657 AN ORDINANCE MAKING CERTAIN AMENDMENTS TO THE ANNUAL BUDGET ADOPTED FOR FISCAL YEAR COMMENCING MAY 1, 1993 AND ENDING MAY 1, 1994 Upon roll call: Ayes: Clowes, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion carried. Mr. Janonis stated that the regular Committee of the Whole meeting scheduled for July 26 is cancelled. TRUSTEE COMMENTS RESIDENTIAL Trustee Henddcks brought up the fact that a pontoon boat is parked PARKING: on a parking pad in the front yard of 1009 Na Wa Ta and expressed 1009 NA WA TA his opinion that this should not be an allowable uae. It was noted that staff had researched this matter and had determined that this particular parking pad was in existence prior to 1979 and therefore is an existing legal non-conforming use. Trustee VVilks complimenting those involved with the July 4th parade and activities. Trustee Wilks also asked that the weekly package delivered to the Trustees' homes be placed between the storm and regular doors in order to be protected from the elements. Trustee Clowes stated that the copies of the JAWA minutes distributed to the Board were of such poor quality that they were illegible and asked that future copies be clear, Page 6 - July 5, 1994 NY OTHER BUSINESS None. EXECUTIVE SESSION EXECUTIVE Trustee Hoefert, seconded by Trustee Skowron, moved to adjourn SESSION: into Executive Session for the purpose of discussing litigation. LITIGATION Upon roll call: Ayes: Clowes, Hendricks, Hoefert, Skowron, VVilks Nays: None Motion carried. The Village Board went into Executive Session at 9:50 P.M.
