AN ORDINANCE AMENDING CHAPTER 8
OF THE VILLAGE CODE OF MOUNT PROSPECT
WHEREAS, the return of checks made payable to the Village for garbage collection
fees and municipal water and sewer charges, are returned unpaid due to there being
insufficient funds in the account upon which they are drawn ("NSF Checks") have a
significant negative effect on Village finances; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find
that the establishment of a penalty for the return of NSF Checks is in the best interest
of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Article V entitled "Other Regulations" of Chapter 8 (Village
Government Miscellaneous Provisions), as amended, is hereby further amended by
adding a new Section, Section 8.516 entitled "Penalty For NSF Checks"; so that
hereafter said Section 8.516 shall be and read as follows:
" Sec. 8.516, Penalty For NSF Checks. If a check is returned to the Village
due to insufficient funds (NSF) of a checking account, the person
to whose Village account was to be credited shall pay a penalty fee of twenty
dollars ($20.00)."
SECTION TVVO: That this Ordinance shall be in full force and effect from and after
its passage, approval and publication in pamphlet form in the manner provided by law.
