II II II II I II II II II II II II I II II I I I I I ORDINANCE NUMBER 2335 AN ORDINANCE REFINING THE FUNCTIONS OF THE MOUNT PROSPECT BOARD OF HEALTH WHEREAS, the Mount Prospect Board of Health suggested certain changes of the regulations affecting it and its functions; and WHEREAS, the Public Health and Safety Committee of the Board of Trustees of the Village of Mount Prospect have reviewed the analyses and studies made by the Board of Health; and WHEREAS, the Public Health and Safety Committee of the Board 6f~Trustees has recommended that the Board of Trustees of the Village of Mount Prospect concur with the recommendations of the Board of Health; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the aforementioned recommendations are in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Article I of Chapter 5 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended by amending Sections 5.102, 5.103, and 5.105 in their entirety; so that hereafter the said Sections 5.102, 5.103, and 5.105 of the said Article I of Chapter 5 shall be and read as follows: IISection 5.102. Organization. A. The members of the Board of Health shall serve without compensation. Immediately upon its organization, the Board shall select from its membership a Chairman, Vice Chairman, and Secretary. The persons so selected shall serve as such for a term of one (1) year, but may be re-elected to said positions. B. The Board shall adopt rules for the conduct of its meetings and hearings, which rules may include the creation of a committee authorized to conduct the appropriate hearings at anytime two or more members of the Board of Health are present. 1. In the case of meetings, however, a majority of the members of the Board shall constitute a quorum to conduct business. 2. The Board shall keep minutes of all such meetings and hearings. q II " II , . II II II II I ! . . Section 5.103. Meetings and Hearings. A . A 11 me e t i ngs and all h ear i n g s of the Board of Heal t h shall be public and the minutes thereof shall be avail- able for examination in the Office of the Village Clerk during regular business hours. B. Regular meetings of the Board of Health shall be held not less than once every three (3) months and upon twenty- four (24) hours written notice thereof to each member of the Board and in the manner provided by law. II C. All hearings shall be held at those times required by law and may be conducted by a committee of the Board of Health. Section 5.105. Duties of the Secretary of the Board of Health. It shall be the duty of the Secretary to keep a written record of all meetings of the Board and of all ordinances proposed, which shall be a public record and shall be kept on file in the Office of the Village Clerk available for public inspection.1I SECTION TWO: That Section 12.103 of Article I of Chapter 12 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended in its entirety; so that hereafter the said Section 12.103 shall be and read as follows: IISection 12.103. Investigation. All applications for a license to engage in the business of food dealer shall be referred to the Health Inspector, who shall make or cause to be made an investigation of the premises proposed by such prospective food dealer for the conduct of such business. The Health Inspector shall report his findings to the Vil- lage Clerk and shall recommend for or against the issuance of such license.1I I II .,1 II II I II II I' i I II II I SECTION THREE: That Section 12.401 of Article IV of Chapter 12 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended by amend- ing the definition of IIHealth Authorityll in its entirety; so that hereafter the said definition located within the said Section 12.401 shall be and read as follows: IIHEALTH AUTHORITY shall mean any or all of the following: the President and Board of Trustees of the Village of Mount Prospect, acting as a Board; the Board of Health of the Village of Mount Prospect, acting as a Board; the Health Officer of the Village of Mount Prospect; the Village Manager of the Village of Mount Prospect; and the Health Inspector of the Village of Mount Prospect.1I SECTION FOUR: That subsection B. of Section 12.409 of Article IV of Chapter 12 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended in its entirety; so that hereafter the said subsection B. shall be and read as follows: I' , j IISection 12.409 I I I! II B. Inspection of food service establishments, food pro- cessing establishments, and/or food stores: At least every three (3) months the health authority shall inspect each food service establishment, food processing establish- ment, and/or food store located within the corporate limits of the Village of Mount Prospect and shall make as many additional inspections and reinspections thereof as may be necessary for the enforcement of the health regulations con- tained in this Municipal Code. 1. Access to Establishments: The health authority, after proper identification, shall be permitted to enter, at any reasonable time, any food service establishment, food processing establishment, and/ or food store within the corporate limits of the Village of Mount Prospect for the purpose of making inspections to determine compliance with this or- dinance. He shall be permitted to examine the records of the establishment to obtain pertinent information pertaining to food and supplies pur- chased, received or used, and persons employed. 2. Food Shelf-life Records: Food dealers and operators of food service establishments, food processing establishments, and/or food stores shall maintain and make available to the Health authority records of the date of processing and/or date of expiration of shelf-life of all foods packaged by such food dealer and of all pre-packaged foods where the processor of such pre-packaged foods provides such written information on the package thereof. 3. Inspection Records: Whenever the health authority makes an inspection of a food service establishment, food processing establishment and/or food store, he shall record his findings on an inspection report form provided for this purpose, and shall furnish a copy of such inspection report form to the holder of the license. Issuance of Notices: Whenever the health authority makes an inspection of a food service establishment, food processing establishment, and/or food store, and discovers that any of the requirements of this ordinance have been violated, he shall notify the licensee, permit holder, or operator of such violations by means of an inspection report form or other written notice. In such notification, the health authority shall: a. Set forth the specific violations found. b. Establish a specific and reasonable period of time for the correction of the violations found. I i II I I ,I II c. State that failure to comply with any notice issued in accordance with the provisions of this ordinance may result in immediate suspension of the license or permit. d. State that an opportunity for appeal from any notice or inspection findings will be provided if a written request for a hearing is filed with the Village Board of Health within the period of time established in the notice for correction.1I SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and pub- lication in the manner provided by law.
