ORDINANCE NO.
AN ORDINANCE CREATING A CLASS "W" LIQUOR LICENSE

BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Section 13.101 of the Municipal Code of Mount Prospect
of 1957, as amended, be and the same is hereby further amended by adding
thereto an additional sentence after the definition of "Restaurant" and
an additional definition for "Drive-In Restaurant", which additional
definition shall be placed in the said Section 13.101 in alphabetical
order; so that hereafter the said definitions of "Restaurant" and "Drive-
In Restaurant" shall be and read as follows:
"Drive-In Restaurant: A food service establishment with or
without interior facilities for eating, which caters to and
permits the consumption of food either in customer's auto-
mobile parked on the premises or in any other designated
area on the premises outside the establishment where the
food is so prepared. 'Drive-In Restaurant' shall not be con-
strued to include 'Restaurant'
Restaurant: Any public place kept, used, maintained, adver-
tised and held out to the public as a place where meals are
served, and where meals are actually and regularly served,
without sleeping accommodations, such space being provided
with adequate and sanitary kitchen and dining room equip-
ment and capacity and having employed therein a sufficient
number and kind of employees to prepare, cook and serve
suitable food for its guests. 'Restaurant' shall not be
construed to include 'Drive-In Restaurant'."
SECTION TWO: That Section 13.106 of the Municipal Code of Mount Prospect
of 1957, as amended, be and the same is hereby further amended by adding
to the said Section 13.106 an additional par~graph to provide for a
"Beer and Wine" license for restaurants; so that hereafter the said addi-
tional paragraph shall be and read as follows:
"Class 'W' license, for issuance to restaurants, which shall
authorize the licensee to sell and offer for sale at retail
beer and wine for consumption on the premises where sold.
(1)
Consumption of alcoholic liquor at or over a bar is
specifically prohibited and any consumption of beer
and wine shall be limited to those patrons who are
dining in such restaurant.
(2) The annual fee, therefor, shall be $1,000.00."
SECTION THREE: That Section 13.107 of the Municipal Code of Mount Pros-
pect of 1957, as amended, be and the same is hereby further ~mended~ to
provide for one (1) Class "W" liquor license; so that the saJ.d SectJ.on
13.107 hereafter shall be and read as follows:
"There shall be issued in the Village of Mount Prospect no
more than:
(a) Three (3) Class A Licenses
(b) Eight (8) Class B Licenses
(c) Nine (9) Class C Licenses
(d) One (1) Class D License
(e1 One (1) Class E License
(f) One (1) Class M License
(g) One (1) Class R License
(h) One (1) Class W License"

SECTION FOUR: That subsection B. of Section 13.114 of the Municipal
Code of Mount Prospect of 1957, as amended, be and the same is hereby
further amended by adding to the said subsection B. "Class W"; so that
hereafter the said subparagra~h B. of Section 13.114 shall be and read
as follows:
"B;- On all premises for which Class A, Class B, Class C,
Class E, Class M, Class R, or Class W licenses have
been issued, there shall be no mechanical pinball
machine or device operated in said premises, provided,
however, that cigarette and candy dispensing machines
are permitted."
SECTION FIVE: That this Ordinance shall be in full force and effect
from and after its passage, approval, and publication in the manner
provided by law.
