AN ORDINANCE UPGRADING THE VILLAGE OF MOUNT PROSPECT
1970 TRAFFIC CODE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Section 18.308 of Chapter 18 of the Municipal Code
of Mount Prospect of 1957, as amended, be and the same is hereby
further amended in its entirety by substituting therefor a new Section
18.308 concerning the latest regulations regarding lane control sig-
nals; so that hereafter the said Section l8.~08 shall be and read as
'follows:
"Section 18.308. Lane-Control Si nals. Whenever lane-control signals
are use ln con]Unctlon Wlt signs, they shall have the
following meanings:

Downward-Pointin~ Green Arrow. A driver facing this indication
is permitted to rive in the lane over which the arrow signal
is located. Otherwise he shull obey all other traffic controls
present and follow normal safe driving practices.
Red X Stmbo1. A driver facing this indication shall not drive
in the ane over which the signal is located, and this indica-
tion shall modify accordingly the meaning of all other traffic
controls present. Otherwise he shall obey all other traffic ,
controls and follow normal safe driving practices.
c.
Yellow X (Steady). A driver facing this indication should pre-
pare to vacate the lane over which the signal is located, in a
safe manner to avoid, if possible, occupying that lane when a
steady red X is displayed."
SECTION TWO: That subsection A. of Section 18.502 of Chapter 18 of the
Munlcipal Code of Mount Prospect of 1957, as amended, be and the same
is hereby further amended by inserting "within the passenger area of"
within the Section in place of the words "in or upon or about"; so that
hereafter the said subsection A. of Section 18.502 shall be and read
as follows:
"Section 18.502. Transportation Of Alcoholic Liquor -- Penalty.
A. No person shall transport, carry, possess or have any alcoholic
liquor within the passenger area of any motor vehicle execpt in
the original package and with the seal unbroken."
~ECT~ON THREE: That, in line with recent state legislation regarding
lmplled consent for drivers of motor vehicles, a new Section 18.505 be
added to Chapter 18 of the Municipal Code of Mount Prospect of 1957
as amended; so that hereafter the said new Section 18.505 shall be ~nd
read as follows:
"Section 18.505. Suspension Of License -- Implied Consent.
A. Any person who drives a motor vehicle anywhere within this
Village thereby consents, under the terms of this Section, to
take and complete a test or chemical analysis of his breath to
determine the alcoholic content of his blood when made as an
incident to and following his lawful arrest, evidenced by the
issuance of a Uniform Traffic Ticket, for an offense as defined
in Section 18.501 of this Chapter.
1. Within a reasonable time following any such arrest, a police
officer shall request the person arrested to submit to such
analysis of his breath upon a breath testing instrument
approved by the Department of Public Health which will auto-
matically display the test results visually to the arrested
person and provide for an automatic printed test record.
a. Such test shall consist of 2 breath analyses taken not
less than 15 minutes apart.
b. Each printed recording shall also contain an automatically
printed record of the reading of the testing device made
immediately prior to the recording for the tested person.
c. Each recording shall contain the date and time on which
the test was given, which may be manually printed on
the recording.
2. The officer shall make an oral statement and concurrently
deliver to the arrested person a printed notice supplied
by the Secretary of State in the English and Spanish
languages and any other languages deemed appropriate by
the Secretary of State which shall advise the arrested per-
son:
a. That by his driving a motor vehicle in this State he
has consented to take two (2) breath analysis tests
which shall be administered not less than 15 minutes
apart to determine the alcoholic content of his blood
when such tests are made as an incident to and following
his lawful arrest for an offense of driving a vehicle
while under the influence of intoxicating liquor;
b. That he may refuse to submit to either such test and
that his refusal to submit to either test within 90
minutes after receiving the notice may result in the
suspension of his privilege to operate a motor vehicle
for three (3) months on his first such arrest and re-
fusal and for six (6) months on his second and each sub-
sequent such arrest and refusal within five (5) years;
c. That he may consult with an attorney or other person by
phone or in person within that 90 minutes~
d. That his failure to submit to and complete the test may
be admitted in evidence against him in any hearing con-
cerning the suspension, revocation or denial of his
license or permit;
e. That he will receive a duplicate original or a photocopy
of the results of any such test to which he submits at
the request of the police;
f. That the results of such tests may be introduced in
evidence against him to support the charge of driving
while under the influence of intoxicating liquor;
g. That a reading of .10% of alcohol in the blood establishes
a presumption of being under the influence of intoxicating
liquor;
h. That he may secure additional chemical tests at his own
expense and that such tests should be taken as soon as
possible and are customarily available from hospitals,
medical laboratories and physicians; and
i. That upon his request full information concerning the
results of such tests he took at the request of the
police officer will be made available to him or his
attorney.
3. After being so advised the arrested person may study the
written notice and may consult with an attorney or other
person by phone or in person but refusal to submit to the
tests within 90 minutes after being given the written
notice shall constitute a refusal to take the test.
Failure to consult counsel shall not excuse or mitigate
the effect of the refusal to take or complete the test.
No tests shall be given to any person without the written
permission of that person;. willful refusal to give such
written permission, however, shall constitute refusal to
submit to the test within the meaning of this Section.
4. If the arrested person is detained in the custody of the
police after such test has been administered, the police
shall, at the request of the arrested person, facilitate
the prompt securing of an additional chemical test by a
qualified person of the arrested person's choice and at
his own expense as authorized by subsection F. of Section
18.501 and shall provide such transportation of the
arrested person as may be necessary for this purpose.
B. Any such test made as an incident to and following the lawful
arrest shall be performed according to uniform standards and
procedures adopted by the Illinois State Department of Public
Health in co-operation with the Superintendent of State Police.
1. Such standards and procedures shall include:
a. Rules and regulations for examining and licensing any
any individual who shall administer any such test.
b. Procedures for revoking the license of any such indi-
vidual.
c. Rules and regulations for examining and certifying
the accuracy of any breath-testing instrument.
2. Any license issued to any individual to conduct such tests
shall expire one year from date of issuance and any indi-
vidual who desires to be licensed again must be re-examined.
Any such breath testing instrument must have been tested
for accuracy and certified accurate pursuant to such rules
and regulations no more than 30 days prior to the day the
arrested person is directed to submit to the test upon the
instrument.
C. Evidence of a refusal to submit to a test or chemical analysis
under this Section is inadmissible in any civil action or pro-
ceeding other than a hearing on the suspension of a person'.s
privilege to operate a motor vehicle as provided under the
provisions of this Section.
1. Evidence of a refusal to submit to a test or chemical
analysis under this Section is inadmissible in an action
under Section 18.501 of this Chapter, or in an action for
violation of a local ordinance prohibiting driving a motor
vehicle while under the influence of intoxicating liquor.
2. No evidence based upon a test or chemical analysis of
breath shall be admitted into evidence in a proceeding
under Section 18.501 unless corroborated by an automat-
ically printed recording of the reading of the testing
device and unless administered within 150 minutes fol-
lowing such lawful arrest of the person tested.
3. No evidence of any test taken pursuant to this Section
is admissible in any proceeding except in a proceeding
under Section 18.501. No evidence of any test may be
submitted in a proceeding under Section 18.501 until
probable cause is shown that the person was operating
a motor vehicle in the Village of Mount Prospect, State
of Illinois while under the influence of alcohol.
D. The arresting officer shall file with the Clerk of the Circuit
Court for the county in which the arrest was made, a sworn
statement naming the person refusing to take and complete the
test requested under the provisions of this Section. Such
sworn statement shall identify the arrested person, his
driver's license number and residence as shown on such license
and shall specify the refusal of said person to take the test
requested and the time, place or places where such request was
made.
1. Said sworn statement shall include a statement that the
arresting officer had reasonable cause to believe the
person was driving the motor vehicle within this Village
and State while under the influence of intoxicating liquor
and that such test was made as an incident to and following
the lawful arrest for an offense as defined in Section
18.501 of this Chapter a similar provision of a municipal
code, and that the person, after being arrested for an
offense arising out of acts alleged to have been committed
while so driving refused to submit to and complete a test
as requested orally and in writing as provided in paragraph
A. of this Section.
2. The said Clerk shall thereupon notify such person in writing
that his privilege to operate a motor vehicle will be sus-
pended unless, within 28 days from the date of mailing of
the notice, he shall request in writing a hearing thereon.
a. If such person fails to request a hearing within such
28 day period, said Clerk shall so notify the Secretary
of State who shall automatically suspend such person's
driver's license as provided in paragraph A. of this
Section.
b. If such person desires a hearing, he shall petition
the Circuit Court for and in the county in which he
was arrested for such hearing. Such hearing shall pro-
ceed in the Court in the same manner as other civil
proceedings, except that the scope of such proceedings
shall cover only,the issues of whether the per~on was
placed under arrest for an offense as defined in
Section 18.501 of this Chapter, whether the arresting
officer had reasonable grounds to believe that such
person was driving while under the influence of in-
toxicating liquor, whether the person was informed
orally and in writing as provided in paragraph A that
his privilege to operate a motor vehicle would be sus-
pended if he refused to submit to and complete the
test and whether, after being so advised, he refused
to submit to and complete the test upon request of the
officer.
E. Any person who is dead, unconscious or who is otherwise in a
condition rendering him incapable of refusal, shall be deemed
to have withdrawn the consent provided by this Section."
SECTION FOUR: That subsection B. of Section 18.605 of the Traffic
Code of the Mount Prospect Municipal Code of 1957, as amended, be and
the same is hereby further amended so that hereafter the said sub-
section B. of Section 18.605 shall be and read as follows:
"B. This Section shall not be applicable unless appropriate signs are
posted upon streets and highways under the respective jurisdic-
t~ons.maintain~dby the St~te of Illinois, township, county, park
dIstrIct, or VIllage whereIn the school zone is located. Such
signs shall give proper due warning that a school zone is being
approached and shall indicate the school zone and the maximum
speed limit in effect during school days when school c}lildren
are present. Nothing in this Chapter shall prohibit the use of
electronic speed-detecting devices within 500 feet of signs
within a special school speed zone indicating such zone, as de-
fined in this Section, nor shall evidence obtained thereby be in-
admissable in any prosecution for speeding provided the use of
such device shall apply only to the enforcement of the speed
limit in such special school speed zone."
SECTION FIVE: That Section 18.701 of Chapter 18 of the Municipal Code
of Mount Prospect of 1957, as amended, be and the same is hereby further
amended by adding a new subsection C. to the said Section 18.701; so
that hereafter the said subsection C. shall be and read as follows:
I~. Upon any roadway having 4 or more lanes for moving traffic and
providing for 2-way movement of traffic, no vehicle shall be
driven to the left of the center line of the roadway except when
authorized by official traffic-control devices designating cer-
tain lanes to the left side of the center of the roadway for
use by traffic not otherwise permitted to use such lanes, or ex-
cept as permitted under Subsection A. 2. However, this sub-
section shall not be construed as prohibiting the crossing of
the center line in making a left turn into or from an alley,
private road or driveway."
SECTION SIX: That Section 18.1002 of Chapter 18 of the Municipal Code
of Mount Prospect of 1957, as amended, be and the same is hereby further
amended by adding thereto a new subsection D. concerning pedestrians'
right-of-way on sidewalks; so that hereafter the said subsection D. of
Section 18.1002 shall be and read as follows:
"D. Pedestrians' right-of-way on sidewalks. The driver of a vehicle
emerging from or entering an alley, building, private road or
driveway shall yield the right-of-way to any pedestrian approach-
ing on any sidewalk or any sidewalk area extending across such
alley, building entrance, road or drivewa.y."
SECTION SEVEN: That Sections 18.1008 and 18.1009 of Chapter 18 of
the Municipal Code of Mount Prospect of 1957, as amended, be and the
same are hereby further amended by deleting the text of Section 18.1008
from Article X of the said Chapter 18; by renumbering the text currently
found under Section 18.1009 to read as under Section 18.1008; and there-
by completely eliminating the need for a section known as I1Section
18.100911; so that hereafter Article X shall terminate with Section
18.1008 -- which Section 18.1008 shall be and read as follows:
I1Section 18.1008. Interference With Other Citizens.
A. Any person who shall wilfully and unnecessarily hinder, ob-
struct, or delay, or who shall wilfully and unnecessarily
attempt to delay, hinder, or obstruct any other person in
lawfully driving or traveling along or upon any Village street
or highway or who shall offer for barter or sale merchandise
on said highway so as to interfere with the effective movement
of traffic shall be guilty of a misdemeanor.
B. It shall be unlawful for any pedestrian to stand upon any
sidewalk except as near as is reasonably possible to the
building line or curb line, if such standing interferes with
the use of said sidewalk by other pedestrians.11
SECTION EIGHT: That subsection J. of Section 18.1101 of Chapter 18
of the Municipal Code of Mount Prospect of 1957, as amended, be and
the same is hereby further amended in its entirety by substituting
therefor a new subsection J; so that hereafter the said new subsection
J. of Section 18.1101 shall be and read as follows:
I1J. The operator of a motorcycle and every passenger thereon shall
be protected by glasses, goggles, or a transparent shield. The
Illinois State Department of Law Enforcement shall determine
the standards for this equipment.11
SECTION NINE: That Section 18.1303 of Chapter 18 of the Municipal Code
of Mount Prospect of 1957, as amended, be and the same is hereby amended
in its entirety by substituting therefor an entirely new Section 18.1303;
which new Section 18.1303 shall be and read as follows:
I1Section 18.1303. Parking Prohibited In Specific Places.
A. Except when necessary to avoid conflict with other traffic, or
in compliance with law or the directions of a police officer or
official traffic control device, no person shall:
1. Stop, stand or park a vehicle:
a. On the roadway side of any vehicle stopped or parked at
the edge or curb of a street;
b. On a sidewalk;
c. Within an intersection;
d. On a crosswalk;
g. Upon any bridge or other elevated structure or within a
highway tunnel, underpass or subway;
h. On any railroad tracks;
l. At any place where official signs prohibit stopping.
2. Stand or park a vehicle, whether occupied or not, except
monentarily to pick up or discharge passengers;
a. In front of a public or private driveway;
b. Within 15 feet of a fire hydrant;
c. Within 20 feet of a crosswalk at an intersection;
d. Within 30 feet upon the approach to any flashing signal,
stop sign, yield sign, or traffic control signal located
at the side of a roadway;
e. Within 20 feet of the driveway entrance to any fire
station and on the side of a street opposite the
entrance to any fire station within 75 feet of such
entrance (when properly sign-posted);
f. At any place where official signs prohibit standing;
g. Upon any berm, shoulder, or parkway adjacent to any
roadway; excluding driveways.
3. Park a vehicle, whether occupied or not, except temporarily
for the purpose of and while actually engaged in loading or
unloading merchandise or passengers:
a. Within 50 feet of the nearest rail of a railroad
crossing;
b. At any place where official signs prohibit parking;
c. At any place where official signs prohibit parking;
provided such sign is included in the appropriate
Schedule(s) of the appendix to this Chapter.
B. No person other than a police officer, as provided in Section
18.1302 of this Chapter, shall move a vehicle into any such
prohibited area or away from a curb such distance as is unlaw~
ful or start or cause to be started the motor of any motor
vehicle, or shift, change, or move the levers, brake, starting
device, gears, or other mechanism of a parked motor vehicle to
a position other than that in which it was left by the owner or
driver thereof, or attempt to do so."
SECTION TEN: That Schedule I of Article XIX of Chapter 18 of the
Municipal Code of Mount Prospect of 1957, as amended, be and the same
is hereby further amended in its entirety by substituting therefor
an entirely new Schedule I; so that hereafter the said Schedule I of
Article XIX shall be and read as follows:

Speed Restrictions
In accordance with Section 18.601, and when signs are erected giving notice
thereof, no person shall operate a motor vehicle in excess of the speed limits
indicated upon the following streets or portions of streets; except that the
provisions of Section 18.605, regarding special speed limit while passing
schools, shall take precedence during school days when school children are
present and shall in no way be construed to be in conflict with this
Schedule I.

"SCHEDULE II. Prohibited Turns
In accordance with the provisions of Section 18.807 and when signs are erected
giving notice thereof, operators of vehicles shall not make the indicated
turning movement upon those streets at the intersections designated below; ex-
cept that where "school hours II is described such turns shall be prohibited at
the hours of 8 A.M. to 9:30 A.M., 11 :30 A.M. to 1 P.M., and 2:30 P.M. to 4 P.M.
on school days only.

SECTION THIRTEEN: That all other ordinances or parts of ordinances In
conflIct with the provisions of this ordinance are hereby repealed, ex-
cept that this ordinance shall in no way affect arrests and/or com-
plaints filed for violations of the former Chapter 18 occurring prior
to the passage and approval of this ordinance in the manner provided
by law.
SECTION FOURTEEN: That the Village Clerk be and is hereby directed to
publIsh the foregoing Traffic Code in pamphlet form, pursuant to the
statutes of the State of Illinois, made and provided.
SECTION FIFTEEN: That this ordinance shall be in full force and effect
as of lZ:Ol a~m. July 1, 1972, and after its passage, approval, and
publication in the manner provided by law.
