AF/ 3/25/97 ORDINANCE NO. 4849 AN ORDINANCE GRANTING A CONDITIONAL USE FOR PROPERTY COMMONLY KNOWN AS 1080 SOUTH ELMHURST ROAD WHEREAS, La Salle Bank (hereinafter referred to as Petitioner) has filed a petition for a Conditional Use for property located at 1080 South Elmhurst Road (hereinafter referred to as the Subject Property) which property is legally described as follows: Lot 3 in Di Mucci's Resubdivision of Lots 3 through 7, inclusive, in Juhnke's Subdivision of part of the Northeast 1/4 of Section 14, Township 41 North, Range 11 East of the Third Principal Meridian, according to the plat thereof registered in the \Office of the Registrar of Titles of Cook County, Illinois on February 27, 1979 as Document 3077963; and WHEREAS, Petitioner seeks a Conditional Use, as provided in Section 14.1703.7, in order to expand the existing drive-thru facilities with canopy at the financial institution; and WHEREAS, a public hearing was held on the request for Conditional Use, designated as ZBA Case No. 4-97, before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of February, 1997, pursuant to proper legal notice having been published in the Mount Prospect Journal and Topics on the 7th day of February, 1997; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees in support of the request being the subject of ZBA 4-97; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given ccnsideretion to the request herein and have determined that the same meets the standards of the Village and that granting a Conditional Use would be in the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use to the Subject Property, which Conditional Use will permit a canopy and three (3) drive-thru teller lanes and one ATM lane, all as shown on the Site Plat attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: That the Village Clerk is hereby authorized and directed to record a certified copy of this Ordinance with the Cook County Recorder of Deeds. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
