ORDINANCE NO. 4863
AN ORDINANCE GRANTING A CONDITIONAL USE FOR PROPERTY
COMMONLY KNOWN AS 208 EAST RAND ROAD
WHEREAS, W. MOLITOR CONSTRUCTION, INC. (hereinafter referred to as Petitioner) has filed
a petition for a Conditional Use for property located at 208 East Rand Road (hereinafter referred to
as the Subject Property) which property is legally described as follows:
Lot 1 in Dutton's Subdivision of that part lying north of Rand Road of the West 140
feet of the East 280 feet of the Northwest Quarter of the Northeast Quarter of Section
34, Township 42 North, Range i 1 East of the Third Principal Meridian (except the
north 400 feet thereof) in Cook County, Illinois
WHEREAS, Petitioner seeks a Conditional Use, as provided in Section t4.1703.3, in order to
operate a tire sales and service "drop-off" automotive service center; and
WHEREAS, a public headng was held on the request for Conditional Use, designated as ZBA Case
No. 7-97, before the Zoning Board of Appeals of the Village of Mount Prospect on the 24th day of
Apdl, 1997, pursuant to proper legal notice having been published in the Mount Prospect Journal and
Topics on the 4th day of ApHI, 1997; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the
President and Board of Trustees in support of the request being the subject of ZBA 7-97; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given
consideration to the request herein and have determined that the same meets the standards of the
Village and that granting a Conditional Use would be in the best interests of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the
President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby
grant a Conditional Use to the Subject Property, which Conditional Use will permit a tire sales and
service "drop-off" automotive service center, as shown on the Site Plat attached hereto and hereby
made a part hereof as Exhibit "A".
SECTION THREE: That the Village Clerk is hereby authorized and directed to record a certified
copy of this Ordinance with the Cook County Recorder of Deeds.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form in the manner provided by law.
