CAF/ 5~29~97 ORDINANCE NO. 4864 AN ORDINANCE AMENDING ORDINANCE NO. 2895 GRANTING A PLANNED UNIT DEVELOPMENT FOR PROPERTY COMMONLY KNOWN AS THE TANK FARMS 2304 TERMINAL DRIVE (UNO-VEN COMPANY) WHEREAS, the Uno-Ven Company (hereinafter referred to as Petitioner) has filed a petition for an amendment to the Special Use in the nature of a Planned Unit Development granted in Ordinance 2895 for the Tank Farms, which amendment would apply to property commonly known as Uno-Ven Company, located at 2304 Terminal Drive and legally described as follows: Parcel 1 The East 690.0 feet of the West 987.1 feet of the south 1175 feet of the North 314 of the West ~ of the Southeast 1/4 of Section 23, Township 41 North, Range 11, East of the Third Principal Meridian. Parcel 2 Easement for ingress and egress to use and permit others to use parcels "A" and "B" and any road thereon and for pedestrian and vehicular traffic for the benefit of Parcel 1 as set forth in Warranty Deed from Helen A. Murphy to the Pure Oil Company dated July 19, 1955 and recorded September 14, 1955 as Document No. 16361581 over the following described Parcels A and B: Parcel "A" Commencing at a point 670.7 feet North of the Southeast comer of said Southwest 1/4 of Section 23; thence West 200 feet on a line parallel with the south line of said southwest 1/4; thence North on a line parallel to the North- South Quarter Section line 60 feet; thence East on a line parallel with said south line 497.1 feet; thence South on a line parallel to the North-South Quarter Section line 6 feet; thence West 297.1 feet to a point 5 feet South of the point of beginning; thence North to the point of beginning. Parcel "B" The East 60 feet of the South 670.7 feet of said Southwest 1/4 of Section 23; and WHEREAS, Petitioner seeks an amendment to the Conditional Use governing the Subject Property to permit the construction of a 5,000 barrel ethanol storage tank and fire suppression pump house; and WHEREAS, a public hearing was held on the request for Conditional Use being the subject of ZBA Case No. 10-97 before the Zoning Board of Appeals of the Village of Mount Prospect on the 24th day of April, 1997, pursuant to proper legal notice having been published in the Mount Prospect Journal on the 4th day of April, 1996; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees in support of the request being the subject of ZBA 10-97; and WHEREAS, the President an~i~eard of .'t:¢Jstees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the BA 10-97 Page 2 of 2 standards of the Village and that the granting of the proposed Conditional Use would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant an amendment to Ordinance No. 2895 granting a Conditional Use in the nature of the Planned Unit Development to permit the construction of a 5,000 barrel (250 gallon) ethanol storage tank and fire pump house to service the Subject Property subject to the following: 1. That prior to the issuance of a building permit, the Petitioner must submit a final engineering plan for review and approval. Additional grading/drainage information will be required during final engineering approval. 2. Prior to the issuance of a building permit for the fire pump house and ethanol tank, the Petitioner must address the additional comments listed in the memorandum dated April 14, 1997 from Wilkie Escondo, Fire Protection Engineer along with related correspondence dated December 31, 1996 from R. Paul Valentine to Richard Reineking, attached hereto and hereby made a part hereof as Exhibit "A~. SECTION THREE: That the Conditional Use granted herein is subject to the Petitioner meeting all other applicable Codes of the Village. SECTION FOUR: That the Village Clerk is hereby authorized and directed to record a copy of this Ordinance with the Recorder of Deeds. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
