HomeMy WebLinkAboutOrd 2413 04/05/1973 - \1 'I I ORDINANCE NO. 2413 AN ORDINANCE GRANTING A SIDE YARD REQUIREMENT VARIATION FOR PROPERTY LOCATED AT 223 NORTH MAIN STREET, MOUNT PROSPECT, ILLINOIS WHEREAS, the Board of Appeals of the Village of Mount Prospect did meet on the 22nd day of February, 1973, at the hour of 8:00 P.M., at the Mount Prospect Village Hall and did hear Case No. 73-5A, pursuant to proper legal notice; and WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear this request for a side yard variation to allow the petitione to construct a residence to within fifteen feet 63/100 inches (15.63) of the side yard lot line instead of the required thirty (30) feet of the lot legally described hereinbelow; and WHEREAS, the Board of Appeals of the Village of Mount Prospect did recommend to the President and Board of Trustees the approval of this request under Case No. 73-5A for the reasons that: (1) There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variation is not based ex- clusively upon a desire to make money; II (3) The conditions upon which the petition for this variation is based are unique in that the pro- perty is a corner lot, having a width of only forty-seven (47) feet and because a thirty (30) foot setback would be required from both streets. If the required thirty (30) foot setback were to be maintained on Isabella Street, the petitioner would only be able to construct a building 12'5" wide; (4) The granting of this variation will not be detri- mental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have concurred with the recommendation of the Board of Appeals that the variation herein be granted; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is for the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 73-5A, being legally described as follows: I II ; ,,,>.~,,,.',,,,,"..',,,,=c,'''~'''''<,...'7<:-'''''-',,,,,,:,,;,,,,~,~~y,,,,"=._~r_ - r Lot 161 in Laudermilk Villa, being a subdivision in the Southeast 1/4 of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-l (Single Family Residence), which zoning classification shall remain in effect subject to the variation granted herein: (a) That the side yard abutting Isabella Street be reduced by fourteen feet 37/100 inches (14.37). SECTION TWO: That all requirements of the Mount Prospect BUildin1 and Zoning Code shall be applicable except the variation noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accordance with the variation hereinbefore mentioned. SECTION FOUR: That the variation granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction commenced within one (1) year of the date said Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
