HomeMy WebLinkAboutOrd 2453 09/11/1973 ORDINANCE NO. 2453 AN ORDINANCE AMENDING CHAPTER 13 OF THE MOUNT PROSPECT MUNICIPAL CODE SECTION ONE: That Section 13.101 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended to insert therein in alphabetical order the definition of "Live Music"; so that hereafter the said definition within Section 13.101 shall be and read as follows: "Live Music - That music produced by a human being as dis- tinguished from mechanical reproduction and played in a restaurant where no other entertainment is permitted ex- cept under separate license." SECTION TWO: That Section 13.106 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is further amended by creating a new liquor license classification, to be known as a Class L license; so that here- after the said Section 13.106 shall have inserted therein, following the Class E classification and preceding the Class M classification, the following paragraph: "CLASS "L" license, for issuance to restaurants offering live music as entertainment at least four (4) evenings of each week, which shall authorize the licensee to sell and offer for sale at retail, in the premises specified for such license, alcoholic liquor for consumption on the premises where sold. (1) Consumption of alcoholic liquor shall be permitted for a longer period of time each day than shall be permitted other liquor license classifications pursuant to the terms of Section 13.115. (2) The annual fee therefor shall be $2,000." SECTION THREE: That Section 13.107 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is further amended to provide for one (1) additional Class B liquor license and one (1) Class L liquor license; so that after the said Section 13.107 shall be and read as follows: "Section 13.107 - Number of Licenses. There shall be issued in the Village of Mount Prospect no more than: (a) Three (3) (b) Eleven (11) (c) Eight (8) (d) Two (2) (e) One (1) (f) One (1) (g) One (1) (h) No (i) One (1) (j) Three (3) Class A Licenses Class B Licenses Class C Licenses Class D Licenses Class E License Class L License Class M License Class R License Class V License Class W Licenses" SECTION FOUR: That Section 13.115 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended by adding thereto provisions to allow Class L liEluor licensees a shorter closing period of time; so that hereafter the said Section 13.115 shall be and read as follows: "Section 13.115. Closing Hours - Sunday Closing. A. It shall be unlawful for licensees holding Class A, B, C, D, E, M, R, V and W liquor licenses created under the terms of this Chapter to sell or offer for sale any alcoholic liquor at retail in the Village, or to permit any person to consume any alcoholic liquor in or on any premises for which a license providing for consumption on the premises has been issued pursuant to this Chapter 13, between the hours of two A.M. to six A.M. on Monday through Friday inclusive; between the hours of three A.M. to six A.M. on Saturday; and between the hours of three A.M. to twelve noon on Sunday; and on January 1 of each year said closing hours shall be from four A.M. to twelve noon. B. It shall be unlawful for licensees holding Class L liquor licenses created under the terms of this Chapter to sell or offer for sale any alcoholic liquor at retail in the Village, or to permit any person to consume any alcoholic liquor in or on any premises for which a license providing for con- sumption on the premises has been issued pursuant to this Chapter 13, between the hours of four A.M. and twelve noon on Sundays and on January 1 of each year, and between the hours of four A.M. and six A.M. on all other days of the year. C . It shall be unlawful for any premises for which a retail liquor dealers license has been issued pursuant to this Chapter 13 to keep open for business or to admit the public to any premises in or on which alcoholic liquor is sold at retail during the hours within which the sale of such liquor is prohibited; provided, that retail establishments, restaurants, and clubs may be kept open during the said hours, but no alcoholic liquor may be sold or consumed by the public during such hours, but nothing con- tained in this Section 13.115 shall be deemed to authorize any such retail establishment, restaurant, or club to keep open for business or to admit the public to such premises at or during any hour when such premises are required to be closed by virtue of the regulations or restrictions imposed by any other provisions of this Municipal Code. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
