HomeMy WebLinkAboutOrd 2456 10/02/1973 ORDINANCE NO. 2456 AN ORDINANCE AMENDING THE DRINKING AGE WHEREAS, the Illinois legislature has passed Public Act 78- 26 to amend "An Relating to Alcoholic Liquorstr; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect deem it to be in the best interests of the citizens of the Village of Mount Pros- pect that its own ordinance be aligned with said Public Act 78-26; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That, pursuant to those powers vested in the President and Board of Trustees of the Village of Mount Prospect under Section 6 of Article VII of the 1970 Constitution for the State of Illinois, as well as other inherent police powers, Section 13.121 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby amended in its entirety to allow persons nineteen (19) years of age and older to drink beer and wine upon licensed premises within the corporate limits of the Village of Mount Prospect; so that hereafter the said Section 13.121 shall be and read as follows: "Section 13.121 - Persons Under Age A. No licensee nor any officer, associate, member, representative, agent or employee of such licensee shall sell, give, or deliver alcoholic liquor to any person under the age of 21 years, ex- cept as provided in paragraph 1 of this subsection A, or to any intoxicated person or to any person known by him to be an habitual drunkard, spendthrift, insane, mentally ill, mentally deficient or in need of mental treatment. No person, after purchasing or otherwise obtaining alcoholic liquor, shall sell, give, or deliver such alcoholic liquor to another person under the age of 21 years except in the performance of a religious ceremony or service except as provided in paragraph 2 of this subsection A. 1. Subsection A of this Section does not apply to the sale, gift, or delivery of beer and wine to persons under the age of 21 years, but at least 19 years of age. 2. It shall be unlawful for any holder of a retail liquor dealer's license, or his agent or employee, to suffer or permit any person under age to be or remain in any room or compartment adjoining or adjacent to or situated in the room or place where such licensed pre- mises is located; provided that this paragraph shall not apply to any person under age who is accompanied by his or her parent or guardian, or to any licensed pre- mises which derives its principal business from the sale of service or other commodities than alcoholic liquor. B . It shall be unlawful for any person to whom the sale, gift, or delivery of any alcoholic liquor is prohibited because of age to purchase, accept a gift of such alcoholic liquor, or have such alcoholic liquor in his possession. 1. If a licensee or his agents or employees believes or has reason to believe that a sale or delivery of any alcoholic liquor is prohibited because of the age of the prospective recipient, he shall, before making such sale or delivery demand presentation of some form of positive identification, containing proof of age, issued by a public officer in the performance of his official duties. 2. No person shall transfer, alter or deface such an identi- fication card; use the identification card of another; carry or use a false or forged identification card; obtain an identification card by means of false information; or other- wise misrepresent his age for the purpose of purchasing or obtaining alcoholic liquor or beverage in any tavern or other place in the Village of Mount Prospect where such alcoholic liquor or beverage is sold. a. No person shall purchase, accept delivery, or have possession of alcoholic liquor in violation of this subsection B. b. The consumption of alcoholic liquor by any per- son under 21 years of age is forbidden, except that a person at least 19 years of age may con- sume beer and wine. 3. The possession, dispensing, or consumption by a person under age of alcoholic liquor in the performance of a reli- gious service or ceremony, or the consumption by a person under age under the direct supervision and approval of the parents or parent of such person under age in the privacy of a home, is not prohibited by this subsection B. C . In every tavern or other place in the Village where alcoholic liquor is sold there shall be displayed at all times in a pro- minent place a printed card which shall be supplied by the Local Liquor Commission and which shall read substantially as follows: 'WARNING TO THOSE UNDER AGE' 'You are subject to a fine up to $200 under the ordinance of the Village of Mount Prospect if you purchase any alcoholic liquor or misrepresent your age for the purpose of purchasing or ob- taining any alcoholic liquor.' -2- D. It shall be unlawful for any parent or guardian to permit any person under age of which he or she may be parent or guardian to violate any provision of this Section." SECTION TWO: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
