JANONIS, VILLAGE MANAGER 1bb M-re, 5) I~ I~ FROM: DIRECTOR OF COMMUNITY DEVELOPMENT DATE: SUBJECT: MAY 12,2006 PZ-12-05 - McKONE DISCONNECTION & ANNEXATION 531 S. DOUGLAS AVE. AND 1200 PRAIRIE AVE. GETTYSBURG DEVELOPMENT - APPLICANT The Applicant has petitioned the Villages of Mount Prospect and Arlington Heights to disconnect one property from each municipality while simultaneously annexing another. Currently, the Subject Properties jut in to the other municipality's jurisdiction and the proposed 'land swap' would help minimize challenges in providing services to the Subject Properties. The Petitioner is seeking approval of a Plat of Disconnection that would disconnect 531 Douglas from Mount Prospect and a Plat of Annexation that would make 1200 Prairie Ave. part of Mount Prospect. At the same time, or in very close proximity to, the Village of Arlington Heights would disconnect 1200 Prairie Ave. and then annex 531 Douglas Ave. The disconnections and annexations would not be effective until the corresponding municipality accepted jurisdiction over each Subject Property. The request requires Village Board review and approval. Staff has worked closely with the Petitioner to ensure the attached documents have been prepared in accordance with Village regulations and applicable laws. Staff recommends approval of the proposal as the 'swap' would allow both municipalities to provide a better level of service to the Subject Properties and would help minimize boundary confusion. Please forward this memorandum and attachments to the Village Board for their review and consideration at their May 16,2006 meeting. AN ORDINANCE DISCONNECTING CERTAIN PROPERTY FROM THE VILLAGE OF MOUNT PROSPECT (531 DOUGLAS AVENUE) WHEREAS, the North Star Trust Company, as Trustee under Trust No. 1500, dated 4/29/88, and Larry McKone, having a beneficial interest in said trust (hereinafter the "Owner"), are the legal owners of record of all land within the territory hereinafter described (hereinafter the "Territory"), there being no electors residing thereon; and WHEREAS, the Owner has filed with the Village Clerk of the Village of Mount Prospect, Cook County, Illinois, a Petition to Disconnect from the Village of Mount Prospect requesting that the Territory be disconnected from the Village of Mount Prospect (hereinafter the "Petition to Disconnect"); and WHEREAS, the Territory, commonly known as 531 Douglas Avenue and legally described on the Petition to Disconnect, which is attached hereto and made a part hereof as Exhibit A, consists of less than 160 acres and is within the corporate limits of the Village of Mount Prospect but contiguous to the corporate limits of the Village of Arlington Heights; and WHEREAS, the Petition to Disconnect was filed by the Owner pursuant to, and in accordance with, 65 ILCS 5/7-1-24 of the Illinois Municipal Code; and WHEREAS, the Owner has filed a petition to annex the Territory into the Village of Arlington Heights, which will not become effective until the approval of this Ordinance by the President and Board of Trustees of the Village of Mount Prospect pursuant to 65 ILCS 5/7-1-24. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE EXERCISE OF ITS HOME RULE POWER, AS FOLLOWS: SECTION 1: The Territory shall be disconnected from the Village of Mount Prospect, Cook County, Illinois, but only after the Territory has been annexed by the Village of Arlington Heights, Cook County, Illinois. SECTION 2: This Ordinance shall be in full force and effect from and after its passage and approval as required by law. EMERSON STREET FOUNDERS ROW LLC (NORWOOD BUILDERS) - APPLICANT The Planning & Zoning Commission transmits their recommendation to approve Case PZ-09-06, a request to create three lots of record for the Founders Row development. The Planning & Zoning Commission heard the request at their April 27, 2006 meeting. Judy Connolly, Senior Planner, summarized the request. She said that the Petitioner would like to modify the existing lot lines to create three lots of record that would mirror the approved development: one lot of record for each building and one lot of record for the private drive. The plat also includes the Emerson Street right-of-way dedication that was required as part of the zoning approval. In addition, the plat denotes the storm water detention location. Ms. Connolly said that the plat had been prepared in accordance with all Village Codes. The Planning & Zoning Commission discussed the Petitioner's request and presented concerns with the proposed plat. The P&Z's concerns included Lot 3 being sold independent of the remaining Lots 1 and 2 and without proper notification and consent. In addition, there was concern that access from the Emerson Street access point could be inhibited at some future time. The Commission asked the Petitioner to explain why 3 lots of record were necessary when several P&Z members identified alternative ways to reconfigure the Subject Property. The Petitioner's Attorney responded to the questions and said that a townhome-ownership development was required to have a separate common area, which dictated the creation of Lot 3, the private drive. He clarified that easements recorded with the property would prevent limiting owners' access to/from the site. There was an involved discussion, and it was confirmed that the proposed configuration was in keeping with Development Agreement Requirements and that the appropriate Village departments had reviewed and approved the proposed plat. The Planning & Zoning Commission voted 7-0 to recommend that the Village Board approve the Founders Row Plat of Subdivision. Chairperson Arlene Juracek called the meeting to order at 7:30 p.m. Richard Rogers moved to approve the minutes of the February 23,2006 meeting and Joseph Donnelly seconded the motion. The motion was approved 6-0; Ronald Roberts abstained from the vote. Chair Juracek informed the Commission that the Petitioners for cases PZ-40-05, PZ-05-06, and PZ-06-06 requested their cases be continued. Richard Rogers motioned to continued the three cases to the May 25, 2006 Planning and Zoning Meeting; Joseph Donnelly seconded the motion. The motion was approved 7-0. At 7:32 p.m., Chairperson Juracek introduced Case No. PZ-09-06, a request for a Plat of Resubdivision, creating three lots of record. Judith Connolly, Senior Planner, summarized the case. She stated that the Subject Property is located on the east side of Emerson Street, between Central Road and Busse Avenue. The site is currently under construction for the approved Founders Row rowhome development. She said the development will contain 2 buildings; each has 7 units for a total of 14 dwelling units, and detached garages with access from a private drive along the rear lot line. The Subject Property is zoned B5 Central Commercial and is bordered by the B5C District to the west, RA Single Family District to the north and east, and R1 Single Family District to the south. Ms. Connolly stated that the Petitioner would like to modify the existing lot lines to create three lots of record. Currently, the Subject Property consists of four lots of record and the new lot lines would mirror the approved development: one lot of record for the private drive, and one lot of record for each building. She said the B5 zoning district does not have minimum lot sizes and each lot is a different size. She stated that the plat also includes the Emerson Street right-of-way dedication that was required as part of the zoning approval. In addition, the plat denotes the storm water detention location. Ms. Connolly said that the Petitioner seeks to create three lots of record by resubdividing the Subject Property. She said the proposed plat was prepared in response to the zoning approval granted for the row home development, Case number PZ-02-05 approved March 1, 2005. She stated that the Engineering Division Arlene Juracek, Chair Planning & Zoning Commission Meeting April 27, 2006 PZ-09-06 Page 2 reviewed the plat and had no objections to the resubdivision. The Engineering Division found that the plat was prepared in accordance with Village Codes. Ms. Connolly said the proposed Plat of Resubdivision was prepared in accordance with Village Codes. Based on these findings, Staff recommends that the Planning & Zoning Commission approve the following motion: "To approve the Founders Row Plat of Subdivision to create a 3-lot subdivision as shown on the Petitioner's plat for 1-17 S. Emerson Street, Case No. PZ-09-06." She stated that the Village Board's decision is final for this case. The Commissioners asked Staff questions concerning site maintenance, specifically how the private drive would be maintained and why it was made a separate lot of record. Ms. Connolly said the association would maintain the driveway and deferred the question of the purpose of the proposed configuration to the Petitioner. Steve Massutta, in-house counsel for Norwood Builders 7458 N. Harlem Ave., Chicago, IL 60631, was sworn in. Mr. Massutta clarified that the development was a townhome development, which required a separate common area. He explained that the long term goal was to eliminate access from Emerson Street once the Village of Mount Prospect acquired the two residences. The site would then be reconfigured to eliminate the driveway from Emerson Street, and 10' of it would be deeded to the Village in exchange for extending the private drive along the east lot line and having access from Central Road and Busse Avenue. Mr. Massutta added that the driveway includes easements to ensure access to the site, but the easements would be eliminated subject to the driveway access being eliminated. The Commission discussed the Village selling and or trading the land to modify the private drive. It was noted that the private drive and Emerson Street driveway were designed to accommodate storm water detention. The Commission discussed in detail how the site could be subdivided in a different configuration that would not create a separate lot of record for the private drive. Mr. Massutta explained that a separate lot of record for the common area was required because it was a townhome development and was required to have its own PIN. The Commission asked why the area of grass between the buildings could not be designated as the common area and stated concerns that Lot 3, the private drive could be sold at a tax sale at some point in the future. Mr. Massutta replied that the lot was not desirable as it was designed to accommodate a portion of the storm water detention. The Commission discussed various configurations for the resubdivision. One Commissioner stated his concern that access from Emerson could be eliminated; the Petitioner said the easements would prevent that situation. After further discussion concerning Lot 3 being sold independent of the other lots, Ms. Connolly reminded the Commission that the site was governed by a specific site plan as it was a Planned Unit development. She said the site could not be redeveloped unless it went through the zoning process to amend the approved PUD, which included appearing before the Planning & Zoning Commission and obtaining Village Board approval. There was further discussion regarding modification to the proposed plat to reconfigure the lots in a different manner. Jennifer Tammen, Norwood Builders 7458 N. Harlem Ave., Chicago, IL 60631, was sworn in. Ms. Tammen clarified some of Commission's questions for Mr. Massutta. In response, Mr. Massutta reiterated that the common area is required to be a separate lot of record and to have its own PIN. The Commission inquired how previous townhome developments were subdivided; Staff could not confirm the details of the previously approved projects at the time. There was additional discussion on whether the laws had changed since the other developments had been approved and whether the number of units dictated a different set of requirements. ~, Arlene Juracek, Chair Planning & Zoning Commission Meeting April 27, 2006 PZ-09-06 Page 3 Chair Juracek reminded Mr. Massutta that he was under oath and asked him to confirm that it is his understanding that a separate PIN is required for this type of development. Mr. Massutta replied that the law firm of Levenfeld Pearlstein confirmed that a separate PIN was required for this type of development and that the plat was configured with consideration for the Village's long-term plan to incorporate the existing dwelling units with the townhome site. Mr. Donnelly asked Mr. Massutta to confirm that the plat would be revised if it is determined the plat should have been done differently; Mr. Massutta said yes. Chairperson Juracek called for additional comments. Hearing none, the public hearing was closed at 8:05 pm. Richard Rogers made a motion to approve the Founders Row Plat of Subdivision to create a 3-10t subdivision as shown on the Petitioner's plat for 1-17 S. Emerson Street (the "Subject Property"). The Petitioner is seeking approval of a plat of a resubdivision that creates 3-10ts of record from four existing lots. MAY 9,2006 SUBJECT: IMRF RESOLUTION FOR ELECTED OFFICIALS The Village Board passed a resolution on September 20,2005 whereby elected officials could participate in the Illinois Municipal Retirement Fund (IMRF) at the voluntary option of each individual elected official. IMRF has communicated to the Village that a revised resolution would be acceptable that considered using the start of an elected official's term as the effective date for coverage. Therefore, the original resolution that was approved by the Village Board in September 2005 and immediately effective could be revised to be effective May 1, 2005. This revision will allow elected officials who chose to participate to become eligible for pension benefits after two full terms (8 years) instead of two terms and a portion of another term to reach the 8 year vesting requirement. The financial impact upon the Village or the elected official who started participating in September to obtain retroactive credit would be negligible, based on the minimal salary level and the length of time between the original effective date and the new date.
