MAYORS REPORT 5/16/06 PROCLAMATION II II I I I "NATIONAL POLICE WEEK" May 14 - 20,2006 WHEREAS, the members of the Police Department of the Village of Mount Prospect play an essential role in safeguarding the rights and freedoms of the Village of Mount Prospect; and WHEREAS, it is important that all individuals know and understand the duties, responsibilities, hazards and sacrifices of their Police Department, and that members of our Police Department recognize their duty to serve the people by safeguarding lift and property, by protecting them against violence, disorder and by protecting the innocent against deception and the weak against oppression; and WHEREAS, on May 15, 2006 thousands of peace officers gathered in our nation's capital to join with the families of their recently fallen comrades to honor those comrades and all others who went before them; and WHEREAS, the Village of Mount Prospect recognizes the men and women of our nation's law enforcement agencies who, at great risk to their personal safety, serve as guardians of peace. NOW, THEREFORE, I, Irvana K. Wilks, Mayor of the Village of Mount Prospect, do hereby proclaim the week of May 14 - 20, 2006 as "NATIONAL POLICE WEEK" in the Village of Mount Prospect and I call upon all individuals to recognize the dedicated men and women of the Village of Mount Prospect Police Department for their efforts to maintain our peaceful community and to also remember the fallen or disabled members of law enforcement agencies throughout our country. WILKS AND BOARD OF TRUSTEES FROM: VILLAGE MANAGER DATE: MAY 12, 2006 SUBJECT: OUTDOOR DINING REGULATIONS Village regulations currently provide for outdoor dining on both public and private property. Consumption of alcoholic beverages in these dining venues is permitted (with the appropriate Liquor License) by Chapter 13 (Alcoholic Liquors) unless the outdoor venue is within 300 feet of a Residential Zoning District. This restriction is commonly referred to as the "Butch McGuire's rule" dating back to the early 1990s. As you may recall, Butch McGuire's was a bar with an extensive beer garden that abutted the backyards of a dozen single-family residences. The impact of the beer garden on the adjoining residences was substantial and severe. When Butch McGuire's closed due to fire, the Village Board adopted the 300-foot rule. By and large, the "Butch McGuire rule" has served the Village well. However, with changes in dining trends in the restaurant industry generally and the on-going redevelopment of Mount Prospect's downtown specifically, this restriction presents severe limitations to realizing desirable dining opportunities in the downtown and throughout the Village. Staff looked at ways to keep the overall protection provided by the "Butch McGuire rule" in place, yet permit, under closely regulated conditions, outdoor dining opportunities, with alcohol service, closer than the current 300' limit. Attached is an Ordinance that would modify the "Butch McGuire rule" by providing for the issuance of a Special Permit by the Liquor Control Commissioner that would allow such an outdoor dining facility to be established. The strength of the "Special Permit" approach is that it allows maximum flexibility for both the issuance and revocation of said Permit. The Ordinance allows the Liquor Control Commissioner to establish "conditions" as part of the permit. These conditions would be in addition to the rules and regulations already in place governing outdoor dining venues. Based on first reading discussion, a neighborhood notice provision has been added. AN ORDINANCE AMENDING CHAPTER 13, "ALCOHOLIC LIQUOR" OF THE VILLAGE CODE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION 1: Chapter 13 entitled "Alcoholic Liquor" of the Village of Mount Prospect Village Code, as amended, is amended further by deleting paragraph D in Section 13.117 "Restrictions on Premises" in its entirety and inserting a new paragraph D, which shall be read as follows: D. Notwithstanding provisions of Chapter 14 or Section 9.115 of this Code, it shall be unlawful for any licensee to serve or permit the consumption of alcoholic beverages in any outdoor area when any portion of the area is located within three hundred feet (300') of any residential zoning district in the Village, except as follows: (1) Any licensee that commenced the conduct of business in an outdoor area within three hundred feet (300') of a residential zoning district prior to January 1, 1989, may continue to operate the outside service area; (2) The Local Liquor Control Commissioner may grant a special permit for the delivery of alcoholic beverages in an outdoor service area subject to the following: (a) The outdoor service area is on public or private property, owned or leased by the licensee, and immediately adjacent to the licensed premises; ----.--~------'~~..,..,=--~~,.-"'-.~.~."'",..,.."'.,'""'"..'=.~'''''.7''.~-=^'T''''"'''''''='~.'''''''''-~'-<--'- (b) The applicant shall send notice bv reQular mail to all residential property addresses within 250 feet of the licensed premises. The notice shall inform such addressee of the licensee's intent to secure a special permit for the outdoor service of alcoholic beveraqes. The form of notice shall be supplied bv the VillaQe ManaQer and shall invite comment on the proposed use from the affected property owners or occupiers. (c) The Local Liquor Control Commissioner has determined that the outdoor service area will not have a detrimental effect on the neighborhood in which the premises is located; (d) The Local Liquor Control Commissioner may place such conditions on the outdoor service area as she or he may deem appropriate; (e) such a special permit may be revoked at any time if the Local Liquor Control Commissioner reasonably believes that the operation of the outdoor area is detrimental to the neighborhood in which it is located and upon such revocation, the Licensee may not reapply for a permit for a period of twelve (12) months following the date of revocation; (f) such a special permit shall be available only to the holder of a Class R, Class S or Class W liquor license; (g) alcoholic beverages may be served in the outdoor area only with the purchase of food; (h) such a permit may be granted only upon receipt by the Local Liquor Control Commissioner and approval by the Village Attorney of a statement signed by the licensee acknowledging and accepting the terms of the special permit; and (i) such a special permit is not transferable and if there is any change in the ownership of the premises, whether by the addition of a new shareholder, partner or limited partner, a new special permit must be obtained by the licensee. SECTION 2: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form in the manner provided bylaw.
