HomeMy WebLinkAboutOrd 2436 06/19/1973 ORDINANCE NO. 2436 AN ORDINANCE GRANTING A FRONT YARD REQUIREMENT VARIATION FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF MURA LANE AND SENECA DRIVE, MOUNT PROSPECT, ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 24th day of May, 1973, at the hour of 8: 00 p.m., at the Mount Prospect Village Hall and did hear Case No. 1-V-73, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request for a front yard variation to allow the petitioner to construct a single family residence to within twenty-nine feet nine and three- fourths inches (29'9-3/4") of the property line adjacent to Mura Lane and to within sixteen feet (16') of the property line adjacent to Seneca Drive on the lot commonly known as 1807 Mura Lane; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recommend to the President and Board of Trustees the approval of this request under Case No. 1-V-73 for the reasons that: (1) There is a practical difficulty and particular hardship on the petitioner: (2) The purpose of the variation is not based exclu- sively upon a desire to make money; (3) The conditions upon which the petition for this variation is based are unique in that the lot is a corner lot, subject to having two (2) front yards; and (4) The granting of this variation will not be detrimental to the public or injurious to surrounding property in. that it will not alter the essential character of the locality, since the existing L-shaped building has setbacks off of Mura Lane and Seneca Drive equal to those setbacks requested herein; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 1-V-73, being legally described as follows: Lot 447 in Woodview Manor, Unit 3 being a Subdivision of part of the Southeast i of Section 24, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-l (Single Family Residence), which zoning classification shall remain in effect subj ect to the variations granted herein: (a) That the yard abutting the frontmost lot line of the subject property adj acent to Mura Lane be reduced to twenty-nine feet nine and one-half inches (29'9!"). .. That the yard abutting the frontmost lot line of the subject property I adjacent to Seneca Drive be reduced to sixteen feet two and i one-half inches (16'2!"). .. (b) SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variation noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village i of Mount Prospect is hereby authorized to issue a building permit for constructiAn in accordance with the variations hereinbefore mentioned. 1 ~ SECTION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application . for a building permit pursuant to such variations is made and construction ~ commenced within one (1) year of the date this said Ordinance becomes effectiv~. , .1 SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
