HomeMy WebLinkAboutOrd 2502 05/21/1974 I I ORDINANCE NO. 2502 AN ORDINANCE AUTHORIZING THE VILLAGE MANAGER TO CONVEY CERTAIN INCORPOREAL HEREDITAMENTS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That, pursuant to the authority contained in Article VII of the 1970 Illinois Constitution, subsection K of Section 4.103 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended to include standards authorizing the Village Manager to convey certain nonpos- sessory interests, namely licenses, in the public lands controlled or owned by the Village of Mount Prospect; so that hereafter the said subsection K shall be and read as follows: "K. To perform such other duties as may be prescribed by Article 5 of Chapter 24 of the Illinois Revised Statutes or may be required of him by Ordinance or Resolution of the Board of Trustees, including: To convey a license, that is, an incorporeal hereditament or a nonpossessory interest in land, to any person, firm, or corpora- tion for the construction, installation, and/or maintenance upon or over public land owned or controlled by the Village of Mount Pros- pect by such person, firm, or corporation of automatic lawn sprinkl- ing systems and of roadway entrance markers or other public, chari- table, or aesthetic insignia. 1. The said license shall not be granted or conveyed, however, until: a. The grantee shall have presented to the Village of Mount Prospect specific drawings, plans, and specifications for the improvement to be erected and constructed upon public lands involved. b . The grantee and the Manager shall sign an agreement approv- ed by the Village Attorney which agreement shall hold harm- less the Village of Mount Prospect, its agents, employees, and representatives from any causes of action arising out of such construction, installation, and/or maintenance of such improve- ment upon or over the said public property. 2. The document containing the license shall set forth the legal des- cription of the land, shall clearly indicate that the grantee will have no possessory interest or estate in the land so described, and shall terminate at such time as may be set forth therein. 3. Both the license and the hold harmless agreement above described shall be recorded with the Cook County Recorder of Deeds within ten (10) days after their execution, whereupon the Director of Building and Zoning of the Village of Mount Prospect shall have power and authority to issue a building permit pursuant to the terms of said license."
