HomeMy WebLinkAboutOrd 2508 07/02/1974 ORDINANCE NO. 2508 AN ORDINANCE AUTHORIZING A VARIATION FROM SECTION 21.1011 OF THE MOUNT PROSPECT BUILDING CODE WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 23rd day of May, 1974, at the hour of 8: 00 p.m. , at the Mount Prospect Village Hall and did hear Case No. 19-V-74, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect, pursuant to authority vested in it under subsection E of Section 14.504 of the Municipal Code .. of Mount Prospect, did hear this request to locate a central air conditioner compress~r " in the front yard of the property commonly known as 100 South Albert Street, Mount ~ Prospect, Illinois; and i ~ . WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the .. approval of this request under Case No. 19-V-74 for the reasons that location of thei compressor in the front yard in this unique instance will be the least offensive to neighbors; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 19-V-74, being legally described as follows: Lot One (1) in Block Thirteen (13) in the Subdivision of part of Blocks 1, 3, 12 and 14, and all of Block Two (2) and Thirteen (13) in Busse's Eastern Addition to Mount Prospect, in the East Half CD of Section 12, Township 41 North, Range 11, East of the Third Princi- pal Meridian, a Plat of which Subdivision was registered June 30, 1926, as Document No. 309555, in Cook County, Illinois; is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-l (Single Family Residence) District, which zoning classification shall remain in effect subject to the variation granted hereinbelow. SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except that Section 21.1011 of the Municipal Code of Mount Prospect of 1957, as amended (Building Code) , shall not govern the placement of a central air conditioning compressor to serve the home located upon the subject pro- perty, and that the location of said compressor shall be that shown upon the plans tached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accord- ance with the variation hereinbefore mentioned. SECTION FOUR: That the variation granted by this Ordinance shall be null and void! and of no force and effect whatsoever unless an application for a building permit purr suant to such variation is made and construction commenced within one (1) year of I the date this said Ordinance becomes effective. l SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
