HomeMy WebLinkAboutOrd 2528 10/15/1974 ORDINANCE NO. 2528 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 16 SOUTH BUSSE ROAD, MOUNT PROSPECT WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 22nd day of August, 1974, at the hour of 8: 00 p.m., at the Mount Prospect Hall, and did hear Case No. 37-V-74, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear request to improve the subject property without tapping into the municipal water ply and to service the property with water from a private well to be located on-site; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect that the request be granted as presented in Case No. 37-V-74; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect did review the matter herein and did recommend to the Board of Trustees of the Village of Mount Prospect that the request be granted; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 37-V-74, legally described as follows: Lot 1 in Jeanette Subdivision, being a resubdivision of the North 113.10 feet of that part of Lot 'E' in Kirchoff's Subdivision, being a subdivision in the Northeast Quarter CD of the Northeast Quarter (;1) of Section 10, Township 41 North, Range 11, East of the Third Principal Meridian, ly- ing South of a line 904.64 feet North of and parallel with the South line of the Northeast Quarter CD of the Northeast Quarter CD of Section 10, in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-1 (Single Family Residence District) , which zoning classification shall remain in effect subject to the following variation granted herein: That Section 21.103 of the Mount Prospect Building Code, adopting Section 114. 1 of the BOCA Basic Building Code be varied so as to allow development of the subject property contrary to the provisions contained in Chapter 23 of the Municipal Code of Mount Prospect of 1957, as amended, so that the subject property may receive water service from a private well to be located on-site. SECTION TWO: That all requirements of the Village of Mount Prospect Building and Zoning Codes shall be applicable except the variation noted in SECTION ONE hereto- fore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accord- ance with the variation hereinbefore mentioned. SECTION FOUR: That the variation granted by this Ordinance shall be null and and of no force and effect whatsoever unless an application for a building permit suant to such variation is made and construction commenced within one (1) year of the date this Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
