HomeMy WebLinkAboutOrd 2529 10/15/1974 ORDINANCE NO. 2529 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 101 WEST PROSPECT AVENUE, MOUNT PROSPECT, ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 27th day of June, 1974, at the hour of 8: 00 p.m. , at the Mount Prospect Village Hall and did hear Case No. 20-V-74, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request for a variation to cover more than seventy-five (75%) percent of the lot and thereby allow the petitioner to construct an addition to the building on the lot commonly known as 101 West Prospect Avenue, Mount Prospect, Illinois; and WHEREAS, the Zoning Board of Appeals of the Village ofMount Prospect did recom- mend to the President and Board of Trustees this approval of this request under Case No. 20-V-74 for the reasons that: (1) There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variation is not based exclusively upon a desire to make money; (3) The conditions upon which the petition for this variation is based are unique in that the lot is a corner lot and adjacent to a municipal parking lot; (4) The granting of this variation will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on July 10, 1974, did review the subject matter of Case No. 20-V-74, and have recommended concurrence with the Zoning Board of Appeals' re- commendation regarding said Case No. 20-V-74; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 20-V-74, be- ing legally described as follows: Lot 15 in Busse's Resubdivision of Lots 1 to 6 inclusive of the Resub- division of Lots 1 to 6 inclusive in Block 4 also of Lots 2 and 3 in Block 5, all of Block 6, Lots 13 to 24 inclusive in Block 7, Lots 17 to 20 in Block 8 all in Meier's Addition to Mount Prospect, a subdivision in the Northwest Quarter of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-3 (Business- Retail and Service District) , which zoning classification shall re- main in effect subject to the variations granted hereinbelow. A. That the subject property be improved so that more than seventy-five (75%) percent of the lot may be covered in accordance with plans attached hereto and hereby made a part hereof as Exhibit A . B . That the parking standards of the Zoning Ordinance be reduced to allow the expansion without the requirements for any additional parking. SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Codes shall be applicable except the variations noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accord- ance with the variations hereinbefore mentioned, provided all other applicable sta- tutes and ordinances are complied with. SECTION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building per- mit pursuant to such variations is made and construction commenced within one (1) year of the date this said Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
