HomeMy WebLinkAboutOrd 2535 11/05/1974 2535 AN ORDINANCE PROVIDING FOR THE MAKING OF A LOCAL IMPROVEMENT IN AND FOR THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: SECTION 1: That a local improvement shall be made in the Village of Mount Prospect, Cook County, Illinois, the nature, character, locality and description of which improvement is as follows: ~----~ ,- . ,-_..~-~...- T'hat the roadway of the 'public alley lytng next .[\)orth of and pa.1'(111e1 to Northwest Highway between Milburn Avenue and Williarn Street and behveen Vlillian.l Street and Louis' Street and between Louis Street and Edward Street and fj:orn George Street to approximately eight-four (84) feet NorthwcBt of the West property line of George Street and between George Street and A Ibext Street and between Albert Street and Mount Prospect Road; and also the alley lying next South of and, parallel to Prospect Avenue between Pine Street and Elmhurst Avenue and between Busse Avenue and I-Oka Avenue and bet-ween I-Oka !\venue and Hi-Lusi A venue and also the a.Hey lying neAi: South of a.nd parallel to Central Road between Hi-Lusi Avenue and \Va-Pella Avenue. Be improved by grading and by constructing a pavem.ent together with all neces sary adjustments and appurtenant construction. -------., The 'width of the pavement to be constructed shall be f01.n-teen (14) feet measured fronl edge to edge, except when noted otherwise on the drawings attacbed hereto. The pavement shall be constructed of seven (7) inch luinimum thickness Portland cement concrete pavement. Details of the limits of the improvements, dimensions and~ po sitions of the various units of construction are shown on the drawings attached hereto and by reference made a part hereof. These are entitled lIVi1lage of Mount Prospect, Illinois, Alley Improvements - 1974, Special Assessment No. " ,. and consist of fourteen (14) sheets. , 1 ~> '\ Specifications governing the various portions of the improvements are the Standard Specifications for Road and Bridge Construction adopted by the Illinois Departnlent of Transportation, July 2, 1973, and pertinent suppler:ilent speci:fi- cations, if any, which specifications are on public file in the office of the Secretary of the Board of Local Improvements and by reference rua.de a part hereto. The grades and elevations of all parts of the irnprovement shall be as indicated on the attached drawings. All elevations are given in feet and decimals thereof above Project Datum. Datum is hereby fixed and established as a level plane One Hundred (100.. 00) feet below West head bolt on fire hydrant at Northeast corner of Owen Street and Northwest Highway. The necessary grading shall be done so that all new pavement shall be con- structed to the elevations shown on.the dl'i;:f.vvingsnereinbefore desc.ribedand shall include all cuts, fills., and 0.11 earth or rocks or other ruaterial to be m.oved, and the removal or relocation or all obstructions in the line of theimprove:ment where such work is necessary for this improvert].ent. The subgrade shall be brought to, the proper form and grade and shall be brought to :a firm compacted surface by rolling, tamping, or other suitable means. All soft and spongy spots and all organic matter shall be entirely removed from the subgrade and the space filled with gravel, cTushed stone. compaCted clay or \ other suitable materials. All surp~us excavated ITLaterial shall be removed from the site of the improvement. Upon the prepared subgrade shall be constructed pavements as herein described. 2; '\ 1 ~ 1 COj\TCRETE PA VEi:vtE NT The Portland Cemc;u~ Concrete Pavement shall be constructed behveen metal for ms not le s s than 10 feet in length. The concyete pave- ITlent shall be constructed on the pJ."E:parec1 su rade to the Hne,) 2_,}d grade:o;, and cross section shown 011 the plans. The Portland Cement Concrete shall consist of a mixture of port- land cement, fine aggregate, coarse aggregate and water as hereinafter described; and shall have an air-entrainment of not less than 3 percent nor more than 5 percent of the volume of the concrete. The proportions of cement, fine aggregate, . coarse aggregate, and water will be determined by the Engineer, before work begins, so as to produce a. workable, plastic concrete having a minimuxn compressive strength of not less than 3, 500 pounds per squa.re inch and a minirnum modulus of rupture of not less than 650 pounds per square inch at the age of 14 days. The use of admu..'i:ure to increase workability of the concrete will not be required. The concrete shall be deposited on the subgrade in succe S S1 ve batches in such a manner as to reguiTc as Ettie handling as P?ssible_., The operation of depositing and spreading shall be continuous between transverse joints. The minimum distance between transverse Qmnrny ,..,.---.- - - joints shall be twenty-five feet. The" concret~_ adjacent to both side forms shall be compacted '.vith a vibrator to elim.inate all honeycombed or porous areas before the finishing operations are initiated. Transverse expansion joints shall be formed by installing, as shown on the plans, ~ ,.': premolded joints filler, tie bar and metal cap of the gage, shape, and dimensions specified. The pavement shall be finished by a float by hand or mechanical method and broomed to leave a non- skid finish. Pavement surf2.ce shall be. true and even.>' The newly laid pavement shall be cured -s for <.I. period of 72 hours in a rO.;;~nner approved by the Engineer. (:; . 3 STORrvi SEWERS AND DR.AJNAGE STRUCTURES Storm sewer shall be ten (10) inches and twelve (12) inches in diameter, as noted on the drawings attached hereto, of X' eel concrete pipe tong.u~e and groove or bell and spigot type joints. Pipe shall be capable of withstanding crushing strength of 3000 pounds per lineal foot when tested by the three edge bearing methode Joints in storm sewer shall be made with cement m.ortar and jute. Manholes shall be forty-eight (48) inch internal diameter of precast rein- forced concrete ring construction. Wall thickness shall be five (5) inches. Base shall be one piece precast reinforced concrete construction, six (6) inches in thickness. The upper two and one half (2t) foot of manhole shall be drawn in, in the shape of a cone so that the diameter at the top opening is 24 inches. Manholes shall be fitted with frames and covers of close grain cast iron, free from sand holes oX' blow holes and having a combined weight of not less than 540 pounds, as sho"vn on the plans. Manholes shall befitted with steps and with clo~ed lid '\'veigh- ing 150 pounds. Inlets shall be twenty-four (24) inch internal diameter and three (3) feet in depth, of precast reiniorced concrete construction. 'Wall thickness shall be five (5) inches. Base shall be one piece precast reiD..forced concrete construction, four (4) inches in thickness. Inlets shall be fitted with extra heavy duty frames and grates of close grain cast iron, free froD:l sand holes or blow holes and ha'<ling combined weight of not less than 520 pounds, as sho'vvn oJ} the plans? and \'V'iL~ grate weighing 125 pounds. Cement shall conform to requirements of iuuerican Society for Testing Materials Designation C-150. IvlISCELLANEOUS CONSTRUCTION Existing combination concrete curb and gutter conflicting with the proposed improvement shall be removed and replaced to like dimensions. All materials shall be new and of the -best quality, suitable for the purpose for which they are to be used. All work shall be done in a workmanlike malli'1.er, under the supe:n,d.sion and superintendence of the Board of Local Improvementss ESTIMATE OF COST The estimate of cost for the above described improvement is as follows: 5 SECTION 2: That the recommendation of the Board of Local Improvements of the Village of Mount Prospect, providing for the im- provement, and the estimate of the cost thereof made by the President of the Board of Local Improvements, both hereto attached and made part hereof, be, and the same are hereby approved. SECTION 3: That said improvement shall be made and the whole cost thereof, together with an amount not exceeding six per cent (6%) of the estimated cost, to-wit: NINETY FOUR, THOUSAND FOUR HUNDRED FORTY THREE AND 95/100 DOLLARS ($94,443.95), which is hereby provided for to apply towards the cost and expense of making, levy- ing and collecting said special assessment and all other expenses allowed by law, being the amount included in the estimate thereof, shall be paid by special assessment, in accordance with the Illinois Municipal Code, Article 9, Division 2, and amendments thereto. SECTION 4: That the aggregate amount herein ordered to be assessed against the property and against the municipality, if any, and also the assessment on each lot and parcel of land herein assessed shall be divided as follows: The said assessment to pay the cost of construction of said improvement and the cost of levying, making and collecting said assessment and all expenses allowed by law, shall be divided into ten (10) installments, in the manner provided by the statute in such case made and provided. So much of the aggregate amount of the assessment as represents the cost of levying, making and collecting the special assessment and all expenses allowed by law, together with all frac- tional amounts so as to leave the remaining installments of the ag- gregate assessment equal in amount and each in multiples of $100.00 shall be apportionate to the first installment of the said special assessment. The first installment shall be due and payable on the 2nd day of January next after the filing of the first voucher issued -2- on account of work done on the said improvement. The second in- stallment of said assessment shall be due and payable one year thereafter, and so on annually until all assessments have been paid. IT IS HEREBY made the duty of the Board of Local Improve- ments of the VILLAGE OF MOUNT PROSPECT, to file in the Office of the Clerk of the Court in which such assessment was confirmed, a certi- ficate signed by the Secretary of the Board of Local Improvements of the VILLAGE OF MOUNT PROSPECT of the date of the first voucher and the amount of the said voucher, within thirty (30) days after the issuance of the said voucher. All installments shall bear interest until paid at the rate of seven per cent (7%) per annum, being the rate now permitted by law. Interest on all installments shall begin to run in accordance with the provisions of the Illinois Municipal Code, Article 9, Division 2, and amendments thereto. Interest on such first installment shall be due and payable and shall be collected at the same time as the first installment. Interest on the second and succeeding installments shall be due and payable and shall be collected with the installments respectively as in said Code relating to special assessment provided. SECTION 5: That for the purpose of anticipating the col- lection of the second and succeeding installments of said assessment for the cost of said improvements, the VILLAGE OF MOUNT PROSPECT shall issue bonds payable out of said installments, bearing interest at the rate of seven per cent (7%) per annum, being the rate now per- mitted by law, signed by the President of the Board of Trustees of the VILLAGE OF MOUNT PROSPECT, and attested to by the Village Clerk of said Village. Said bonds shall be issued in accordance with and shall in all respects conform to the provisions of the Illinois Muni- cipal Code, Article 9, Division 2, and amendments thereto. SECTION 6: That the President of the VILLAGE OF MOUNT PROSPECT be and he is hereby directed to file a Petition in the Cir- -3- cuit Court of Cook County, Illinois, in the name of the people of the VILLAGE OF MOUNT PROSPECT, praying that steps may be taken to levy a special assessment for the purpose of defraying the expense of said improvement so far as the same may lawfully be done and to as- certain what property will be benefited, in accordance with the pro- visions of this ordinance, and in the manner prescribed by law. SECTION 7: That all ordinances, or parts of ordinances, in conflict with this ordinance, be, and the same are hereby repealed.
