HomeMy WebLinkAboutOrd 2548 12/03/1974 II II I~ I ('1 I, H ,;, AN 1; 1! ;1 ij! ~ ' ORDINANCE NO. 2548 I I I I I I Village of Mount prospeht I on the 24th day of ; the Mount Prospect pursuant to proper ORDINANCE GRANTING FRONT YARD REQUIREMENT VARIATIONS FOR PROPERTY LOCATED AT 1120 GREENFIELD LANE, MOUNT PROSPECT, ILLINOIS H nWHEREAS, the Zoning Board of Appeals of the lldid meet on the 25th day of July, 1974, and HOctober, 1974, at the hour of 8:00 p.m., at llVil1age Hall and did hear Case No. 28-V-74, Illegal notice; and !i IlwHEREAS, the Zoning Board of Appeals of the Village of Mount prospett Ildid hear this request to construct a second story addition to the ,iexisting building with a front yard setback of twenty-four feet lljten inches (24~10") of the property line adjacent to Greenfield !Lane, and to w4thin twenty-five feet (251) of the property line ladjacent to Barberry Lane on the lot commonly known as 1120 ,Greenfield Lane, Mount Prospect, Illinois; and I IWHEREAS, the Zoning Board of Appeals of the Village of Mount Prospe t Idid recommend to the President and Board of Trustees of the Village lof Mount Prospect the approval of this request under Case No. 1!28-V-74 for the reasons that: i (1) There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variations is not based exclu- sively upon a desire to make money; (3) The conditions upon which the petition for these variations is based are unique in that the lot is a corner lot, subject to havin~ two (2) front yards; and (4) The granting of these variations will not be detrimental to the public or injurious to surrounding property in that they will not alter the essential character of the 1 0 c a 1 i ty; arid HEREAS, the President and Board of Trustees of the Village of ount Prospect have reviewed the matter herein and have determined hat the same is in the best interests of the Village of Mount rospect; OW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF RU$TEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: That the property being the subject matter of Case , being legally described as follows: Lot 258 in Brickman Manor First Addition Unit No.3, being a subdivision of part of the Southwest Quarter (1/4) of Section 26, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois, s currently zoned under the Zoning Ordinance of the Village of unt Prospect as R-1 (Single Family Residence) District, which oning classification shall remain in effect subject to the vari- tions granted herein: II II If n n H Ii II II H Ii 1) jJ II Ii !ISECTION TWO: That all requirements of the Mount Prospect Building Hand Zoning Code shall be applicable except the variations noted in liSection One heretofore mentioned. I ,bECTION FOUR: That the variations granted by this Ordinance shall Ilbe null and void and of no force and effect whatsoever unless an I IIapp1ication for a building permit pursuant to such variations is I I!made and construction commenced within one (1) year of the date I Ithis said Ordinance becomes effective. I I 'SECTION FIVE: That this Ordinance shall be in full force and I effect from and after its passage, approval, and publication in the manner provided by law. .---- ( a) That the yard abutting the frontmost lot line of the subject property adjacent to Greenfield Lane be reduced to twenty-four feet ten inches (24110"). (b) That the yard abutting the frontmost lot line of the subject property adjacent to Barberry Lane be reduced to twenty-five feet (251).
