AN ORDINANCE AUTHORIZING A VARIATION
FROM SECTION 21.1011 OF THE MOUNT PROSPECT
BUILDING CODE
WHEREAS, the Zoning Board of App~als of the Village of Mount Prospect did meet
on the 27th day of March, 1975, at the hour of 8: 00 p.m., at the Mount Prospect
Village Hall and did hear Case No. 9-V-75, pursuant to proper legal no,tice; and
WHEREAS, tl').e Zoning Board of Appeals of the Village of Mount Prospect did hear
this request to locate a central air conditioning compressor in the side yard of the
property commonly known as 114 North Owen Street, Mount Prospect, Illinois; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees of the Village of Mount Prospect the ap-
proval of this request under Case No. 9-V-75 for the reason that location of the com-
pressor in the side yard in this unique instance will be the least offensive to neigh-
bors; and
HEREAS, the President and Board of Trustees of the Village of Mount Prospect
ave reviewed the matter herein and have determined that the same is in the best
rnterests of the Village of Mount Prospect;
~"OW, THEREFORE, BE IT ORDAINED BY THE PB.ESIDENT AND BOARD OF TRUSTEES
pF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, JLLINOIS:
ECTION ONE: That the propeI1ty being the subject matter of Case No. 9-V-75,
eing legally described as follows:

Lot A in Hatlen's Resubdivision of Lots 1 to 8, both in~lusive, and
Lots 11 to 17, both inclusive in Park View, being a SUbdivision of
the East 719.50 feet of the West 1126.50 feet of the Southeast Quar-
ter (;D of the Southeast Quarter CD of Section 34, Township 42
North, Range 11, East of the Third Principal Meridian, except the
North Half (~) of the East 554.25 feet of the West 1126.50 feet of the
Southeast Quarter (i) of the Southeast Quarter CD of Section 34,
Township 42 North, Range 11, East of the Third Principal Meridian,
according to Plat of said Hatlen's Resubdivision, registered in the
Office of the Registrar of Titles of Cook County, Illinois, on May 6,
1957, as Dooument Number 1736735,
1 currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
.l -1 (Single Family Residence) District, which zoning classification shall remain in
. 'feet subject to the variation granted hereinbelow.
CTION TWO: That all requirements of the Mount Prospect Building and Zoning
ode shall be applicable except that Section 21.1011 of the Municipal (jode of Mount
ospect of 1957, as amended, (Building Code) shall not govern the placement of a
,ntral air conditioning compressor to serve the home located upon the subj~ct pro-
rty, and that the location of said compressor shall be that shown upon the plans
tached hereto and hereby made a part hereof as Exhibit "A" .

ECTION THREE: That the Director of Building and Zoning of the Village of Mount
rospect is hereby authorized to issue a building permit for construction in accord-
nee with the variation hereinbefore mentioned.
ECTION FOUR: That the varia~ion granted by this Ordinance shall be null and
oid and of no force and effect whatsoever unless an application for a building
ermit pursuant to such variation is made and construction commenced within '
ne (1) year of the date this said Ordinance becomes effective.
ECTION FIVE: That this Ordinance shall be in full force and effect from and
fter its passage, approval, and publication in the manner prov.ided by law.
