ORDINANCE NO. 2580
.AN ORDINANCE AIITHORIZING A VARIATION
FROM SECTION 21.1011 OF THE MOUNf PROSPECT
BUILDING CODE
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
meet on the 24th day of July, 1975, at the hour of 8:00 p.m., at the
Mount Prospect Village Hall and did hear Case No. 26-V-75, pursuant to
proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect,
pursuant to authority vested in it under subsection E of Section 14.504
of the Municipal Code of :Mount Prospect, did hear. this request to locate
a central air conditioner compressor in the front yard of the property
comonly known as 1000 S. Na Wa Ta, Mount Prospect, Illinois; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
recommend to the President and Board of Trustees of the Village of Mount
Prospect the approval of this request under Case No. 26-V-75 for the
reasons that location of the compressor in the front yard of this unique
instance will be the least offensive to neighbors; and
WHEREAS, the Building Cornmi ttee of the Board of Trustees of the Village of
Mount Prospect did conduct a hearing on August 13, 1975, and did
recommend to the Board of Trustees of the Village of MOlmt Prospect the
granting of the requested variation under Case No. 26-V-75; and
WHEREAS, the President and Board of Trustees of the Village of MOlmt
Prospect have concurred with the recommendation of the Building Committee
that the variation herein be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the same
is in the best interests of the Village of Mount Prospect;
KOW, THEREFORE, BE IT ORDAINED BY TIffi PRESIDENT AND BOARD OF TRUSTEES OF
TIffi VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 26-V-75,
belng legally described as follows:
Lot 52 in Kaplan-Braun's Fourth Addition to Mount Prospect
Unit No.1, being a Subdivision of part of the North Half
of Section 14, Township 41 North, Range 11, East of the
Third Principal Meridian, in Cook County, Illinois,
is currently zoned under the Zoning Ordinance of the Village of MOlmt
Prospect as R-l (Single Family Residence) District, which zoning classifi-
cation shall remain in effect subj ect to the variation granted herein.
SECTION TWO: That all requirements of the Mount Prospect Building and
Zoning Code shall be applicable except that Section 21.1011 of the
Municipal Code of Mount Prospect of 1957, as amended (Building Code), shall
not govern the placement of a central air conditioning compressor to serve
the home located upon the subj ect property, and that the location of said
compressor shall be that shown upon the plans attached hereto and heregy
made a part hereof as Exhibit ",N'.
SECTION 1HREE: That the Director of Building and Zoning of the Village
of :Motn1t Prospect is hereby authorized to issue a building penni t for
construction in accordance with the variation hereinabove mentioned.
SECTION FOUR: That the variation granted by this Ordinance shall be null
and vOld and of no force and effect whatsoever unless an application for
a building penni t pursuant to such variation is made and construction
commenced "Vd thin one (1) year of the date this said Ordinance becomes
effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from
and after lts passage, approval, and publication in the manner provided
by law.
