ORDINANCE NO. 2587
AN ORDINANCE GRANTING A VARIATION FOR
PROPERTY LOCATED AT 910 GREENFIELD COURT

IIWHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did meet
r on the 28th day of August. 1975. at the hour of 8: 00 p.m. . at the Mount Prospect
! Village Hall and did hear Case No. 34-V-75. pursuant to proper legal notice; and

II WHEREAS. the Zoning Board of Appeals of the Village of Mount Prospect did hear
III this request for a side yard variation to allow the petitioner to construct an addi-
I tion to the existing residence to within six feet four inches (6'4") of the east lot
I line of the subject property on the lot commonly known as 910 Greenfield Court; and
WHEREAS. the Zoning Board of Appeals of the Village did recommend to the Preside
I and Board of Trustees the approval of this request under Case No. 34-V-75 for the
I reasons that:

(1)
There is a practical difficulty and particular hardship
on the petitioner;
(2) The purpose of the variation is not based exclusively
upon a desire to make money; ,
(3) The conditions upon which the petition for this variation
is based are unique in that the lot is pie-Shaped, being
narrower at the front than at the back; and
(4) The granting of this variation will not be detrimental to
the public or injurious to surrounding property in that
it will not alter the essential character of the neighborhood;
and

WHEREAS. the Building Committee of the Board of Trustees of the Village of Mount
i Prospect did meet on September 9, 1975. and have reviewed the recommendations

II of the Zoning Board of Appeals under Case No. 34-V-75, and further have recom-
I mended that the Board of Trustees of the Village of Mount Prospect concur in the
recommendations of the Zoning Board of Appeals; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect hav
reviewed the matter herein and have determined that the same is in the best interest
of the Village of Mount Prospect;

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOAm> OF TRUSTEE
I OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 34-V-75, bei g
legally described as follows:

Lot 333 in Brickman Manor First Addition Unit No.3, being a sub-
division of part of the Southwest Quarter (1) of Section 26, Town-
ship 42 North, Range 11, East of the Third Principal Meridian, in
Cook County, Illinois,

s currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
-1 (Single Family Residence) . which zoning classification shall remain in effect
ubject to the variation granted herein: .
That the side yard lot line on the east side of the SUbject property
be reduced to within six feet four inches (6'4").
ECTION TWO: That all requirements of the Mount Prospect Building and Zoning
ode shall be applicable except the variation noted in SECTION ONE heretofore
entioned.
ECTION THREE: That the Director of Building and Zoning of the Village of Mount
rospect is hereby authorized to issue a building permit for construction in accord-
ce with the variation hereinbefore mentioned and pursuant to the sketch thereof
ttached hereto and hereby made a part hereof as Exhibit I.
ECTION FOUR: That the variation granted by this Ordinance shall be null and void
d of no force and effect whatsoever unless an application for a building permit pur
I uant to such variation is made and construction commenced within one (1) year of
e date this said Ordinance becomes effective.
ECTION FIVE: That this Ordinance shall be in full force and effect from and after
ts passage, approval, and publication in the manner provided by law.
